Adopt Zoning Ordinance 25-18 to amend Articles 2.03 (Definitions), 2.48 (Use-Specific Standards), and various zoning district sections of the Zoning Regulations to update terminology and provisions related to Accessory Living Quarters (ALQs).

Background:

Docket R-25-03 is a proposed text amendment to the Cochise County Zoning Regulations, specifically Articles 2.03 (Definitions), 2.48 (Use-Specific Standards), and various zoning district sections of the Zoning Regulations to update references to Accessory Living Quarters (ALQs), retitle them as Accessory Dwelling Units (ADUs), and ensure compliance with A.R.S. § 11-810.01. The proposed amendments include a revised definition of ADUs, updated development standards and approval procedures, and minor revisions to the permitted accessory use provisions in the RU, R, SM, SR, MR, NB, and GB zoning districts to reflect ADUs as permitted accessory uses on parcels where single-family dwellings are allowed.

Department's Next Steps (if approved):

The Department will update the Cochise County Zoning Regulations to reflect approved amendments.

Impact of NOT Approving/Alternatives:

The Cochise County Zoning Regulations would remain in effect without the proposed amendments. The County will be out of compliance with state law, State default regulations will take effect January 1, 2026, regardless of County action, and will override any local zoning codes that conflict with them.
