Agenda Item Text:
Discussion and possible action regarding a letter to the U.S. Department of Justice concerning voting system accreditation and certification.
Pursuant to A.R.S. § 38-431.03(A)(3), the Board may vote to enter executive session for legal advice from the County Attorney.
Pursuant to A.R.S. § 38-431.03(A)(3), the Board may vote to enter executive session for legal advice from the County Attorney.
Background:
The Board of Supervisors has prepared a draft letter to the U.S. Department of Justice requesting clarification regarding the accreditation of Voting System Test Laboratories (VSTLs), the certification of ES&S voting systems, and the use of engineering change orders in recent elections. These issues raise statutory and constitutional questions concerning compliance with Arizona election law and the lawful tabulation of ballots.
The purpose of this agenda item is to review and finalize the draft correspondence before transmittal. The Board may enter executive session, pursuant to A.R.S. § 38-431.03(A)(3), to receive legal advice from the County Attorney on the content of the letter and related legal considerations.
