Discussion regarding Board-suggested amendments to Arizona’s Open Meeting Law (A.R.S. § 38-431 et seq.) for potential introduction at the Arizona Legislature.
Background:
Arizona’s Open Meeting Law governs meetings of public bodies, including the Board of Supervisors and County boards/commissions. In recent years, practical challenges have emerged around technology use and day-to-day administration—e.g., remote participation, electronic communications, agenda posting timelines, serial communications, quorum pitfalls for advisory bodies, public comment management, and the process for curing alleged violations. These issues can create uncertainty for members, staff, and the public, and may increase administrative burden without improving transparency.
Department's Next Steps (if approved):
Following Board discussion, staff (in coordination with the County Attorney’s Office and, as appropriate, the County Supervisors Association and legislative delegation) would translate the Board’s priorities into draft concepts and proposed bill language, coordinate stakeholder outreach, and return at a future meeting for formal Board approval of a legislative position and any related correspondence.
