Pursuant to A.R.S. § 38-431.03(A)(3) and (A)(4), the Board may vote to enter executive session to receive legal advice from the County Attorney or other legal counsel regarding the submitted Notice of Claim; and discuss and consult on the County’s legal position, potential exposure, and options for resolution or response.
Background:
On June 9, 2025, the Clerk of the Board received a Notice of Claim submitted by legal counsel on behalf of Supervisor Terry Thomas Crosby pursuant to A.R.S. § 12-821.01. The claim seeks indemnification from Cochise County in the amount of $300,000, alleging legal expenses incurred by Supervisor Crosby in defending a criminal prosecution related to actions taken in his official capacity during the November 2022 election canvass.
The claim asserts that Supervisor Crosby acted within the scope of his duties as an elected official and that the County is legally obligated to indemnify him under principles of agency and public official immunity. On June 20, the Board approved retaining Mick Rusing as outside legal counsel on this matter. The Board will meet in executive session to receive additional legal advice regarding the claim and to discuss potential options for response.
