Approve a $30,571.95 fund transfer from the General Fund Contingency to the Cochise County Attorney’s Office – Civil Division wages to increase the Chief Civil Deputy County Attorney’s salary in support of competitive market recruitment.

Background:

Civil attorneys manage highly specialized, complex matters that carry significant financial exposure to the County. Specialties include employment law, complex civil litigation, contracts, land use, federal and state regulatory compliance. To attract and retain attorneys with this level of specialized expertise, we must compete with the private market, where these skills command higher compensation. The Chief Civil Deputy would not only possess these skills at the highest level, but would serve the office in a supervisory role managing and developing civil attorneys with these skills. 

Fiscal Impact & Funding Sources: The fiscal would be $10,190 for the remainder of FY26 (March 1 - June 30). The yearly impact would be $30,571.95 which would include salary and ERE's.

Advertise the position with the adjusted compensation package.

Impact of NOT Approving/Alternatives:

Allowing this position to remain unfilled or hiring a less qualified candidate would leave the County exposed to liabilities that would likely exceed the salary gap funding being requested. It would also leave the line attorneys in the Civil Division without adequate, knowledgeable supervision and training.

The fiscal would be $8,110.00 for the remainder of FY26 (March 1 - June 30). The yearly impact would be $24,577.00 which would include salary and ERE's.
