Discussion and Possible Direction Regarding Updating the Fee Structure and Intergovernmental Agreements (IGAs) for Election Services Provided by Cochise County to Municipalities.

Background:

Cochise County conducts elections on behalf of incorporated municipalities pursuant to Arizona law and through Intergovernmental Agreements (IGAs) executed between the County and individual municipalities.
Under A.R.S. § 16-205, the county officer in charge of elections is responsible for conducting elections for political subdivisions of the state, including cities and towns, when requested. Municipal candidate elections are generally held in conjunction with state and county elections as prescribed in A.R.S. § 16-204, which establishes consolidated election dates.
Additionally, A.R.S. § 11-952 authorizes public agencies, including counties and municipalities, to enter into intergovernmental agreements for joint or cooperative action. The County’s provision of election services to municipalities is formalized through such IGAs.
Pursuant to A.R.S. § 11-251(9) and A.R.S. § 11-201(A)(5), the Board of Supervisors has authority over county fiscal matters and the management of county affairs, including the establishment of fees necessary to recover costs associated with services provided.
Municipalities are responsible for the costs of their elections, and counties may recover expenses incurred in conducting those elections on their behalf. Current IGAs establish the scope of services and the methodology for calculating and billing election-related costs.
