Adopt Resolution 12-50 canceling the Fry Fire District Board November 6, 2012 election for the two 4-year boards seats up for election and appointing the candidate (Bess F. Banister) who filed to run in the election to fill one open board position, with all the powers and duties of that office as if elected to that office, effective the 1st day of December 2012; and, resolving that the other open board position is hereby declared vacant, effective the 1st day of December 2012, to be filled by the board members at that time.
Background:
A.R.S. 48-802 (D)(4) provides that the Board of Supervisors may cancel the election for Fire District Governing Board seats and appoint the person who filed nomination papers to fill the position when the number of positions is equal to or more then the number of persons who filed nominaton papers.
Department's Next Steps (if approved):
Notify Fire District and the candidate of the cancellation of the election and appointment.
Impact of NOT Approving/Alternatives:
Fry Fire District will incur cost of election and have vacant positions on their governing board.
