Discussion and possible direction to staff and legal counsel regarding approval to enter into the National Opioid Settlement with the Six Remnant Defendants, CL-2016086.

Pursuant to A.R.S. ยง 38-431.03(A)(3) and (4), the Board of Supervisors may convene in Executive Session for legal advice and to discuss and consider its position and instruct its attorneys regarding the National Opioid Settlement with the Six Remnant Defendants.

Background:

Cochise County has received confirmation from the National Opioids Settlements Notice and Claims Administrator that its Participation Form for the National Opioid Settlement with the Six Remnant Defendants has been submitted. This settlement is separate and distinct from the previously approved One Arizona Opioid Settlement.

At this time, Board of Supervisors approval is required to formally authorize the County to enter into this additional settlement, as no prior approval has been identified. The proposed Executive Session will allow the Board to receive legal advice, review settlement documents, and discuss its position regarding participation in the settlement. Settlement materials will be provided by legal counsel during Executive Session.
