Agenda Item Text:

Adopt Resolution 12-66 canceling the Fairfield Estates RIMD District Board November 6, 2012 election for the three 4-year board seats up for election and appointing the candidates (Mark Boggie and Fredrick Townsend) who filed to run in the election each to one of the open board positions, with all the powers and duties of that office as if elected to the office, effective the 1st day of January 2013; and, resolving that the other open board position is hereby declared vacant, to be filled by the Board Members at that time.

Background:

A.R.S. 48-1082 provides that the Board of Supervisors may cancel the election for a Special District Governing Board seat and appoint the person who filed nomination papers to fill the position when the number of positions is equal to or more then the number of persons who filed nomination papers.

Department's Next Steps (if approved):

Notify the Fairfield Estates RIMD District of the election cancellation; appointment of Board members and declaration of Board vacancy.

Impact of NOT Approving/Alternatives:

Fairfield Estates RIMD  will incur cost of election

To BOS Staff: Document Disposition/Follow-Up:

After BOS signature, have resolution recorded and send a copy to the Elections office.
