REQUESTED ACTION:

MOTION TO APPROVE: Approval of the Construction Contract Procurement Procedure

WHAT THIS ACTION ACCOMPLISHES:

This provides the initial procedure that governs MTECC’s procurement of construction contract services including road and street, mass transit, and related construction activities in support of MTECC’s mission to support the delivery of projects on behalf of MTECC members.

SUMMARY EXPLANATION/BACKGROUND:

MTECC staff developed the Construction Contract Procurement Procedure using the Florida Department of Transportation (FDOT) Road and Bridge Contract Procurement (FDOT Procedure 375-000-001-y) as the starting point that is updated for current laws, rules, regulations and procedures for the implementation of federal grant funded projects from FDOT (federal highway funds), Federal Transit Administration and other federal funding programs.

 

Summaries of adjustments to the FDOT procedure include the following:

 

· Added reference to the FDOT Local Agency Program (LAP) Manual and more details in the procedure directly tied to the LAP Manual.

· Includes a Technical Review Committee to review and recommend the bid as the low bid that is responsive and responsible to the Solicitation Documents. The Technical Review Committee is composed of three that incudes representatives from the MTECC member such as the public works director and project manager with the MTECC Program Manager.

· Matched to MTECC processes for e-procurement and titles including MTECC Contracting Officer, MTECC legal counsel, MTECC Program Manager and MTECC Executive Director.

· Adjusted for legal requirements related to local governments for items such as bid bonds, protest processes, contract performance and payment bonds, and related items.

· All contractors that are considered must be prequalified with FDOT.

· Final contract approval and signature rest with the MTECC Executive Director.

The proposed Construction Contract Procurement Procedure is attached.

MTECC STAFF RECOMMENDATION(S):

Recommend approval of the proposed Construction Contract Procurement Procedure effective March 2026.
