WHAT THIS ACTION ACCOMPLISHES:
Approval of this action will amend eight projects, described below, in the adopted FY 2022 - 2026 TIP. No other projects in the TIP will be affected by the proposed Amendments.
SUMMARY EXPLANATION/BACKGROUND:
1. Broward MPO Request to Program Additional Funding Allocated to the Broward MPO in the Recently Passed Federal Transportation Bill - Infrastructure Investment and Jobs Act (IIJA):
2. The Florida Department of Transportation Request to Add Five New Projects and One Phase to an Existing Project
At the upcoming meeting, MPO staff will make a brief presentation on the proposed TIP Amendments and address any questions or comments. For the PowerPoint presentation, please see Attachment 4.
President Biden signed the Infrastructure Investment and Jobs Act (IIJA) (H.R. 3684) on November 16, 2021. The IIJA is a reauthorization of the Fixing America's Surface Transportation Act and provides $973 billion in funding over five years from Federal Fiscal Year (FFY) 2022 through FFY 2026 for all transportation modes through formula funds and discretionary grants. It extends and increases formula funding for transportation. Federal Highway Administration (FHWA) is continuing to release implementation guidance for programs in the IIJA.
The Broward MPO staff estimated increases to MPO attributable funding from the IIJA using the methodology from the Florida Department of Transportation (FDOT) to allocate federal formula funds. As a result, Broward MPO’s attributable funds (STP URBAN AREAS > 200K [SU], known as Transportation Management Area [TMA], and Transportation Alternatives Program funds [TALU)]) are expected to increase about 21% and 46%, respectively, translating into an annual increase of approximately $5,964,818 and $1,059,531, respectively. The IIJA also includes a new funding program, the Carbon Reduction Program, which is anticipated to generate approximately $1,327,257 annually for the MPO. In summary, the Broward MPO anticipates an annual increase of approximately $8 million in formula funds over the life of the IIJA beginning in current FFY 2022. In order to allocate the funding, FHWA passes down formula funds to the states. FDOT Central Office is then responsible for allocating and providing guidance for formula funds to Districts and MPOs. Currently, District Four is awaiting guidance from Central Office to use these formula funds, thus formula funds are not ready to be authorized by FDOT.
In anticipation of the final funding authorization from FDOT, the MPO is proactively allocating funding to advance the organization's financial stability and ongoing planning efforts through the Unified Planning Work Program (UPWP). The proposed amendment will establish a funding reserve for MPO operations in FY 2022 and will allocate funding in FY 2023 and 2024 to support increased emphasis on funding safety, resiliency, and complete streets.
To ensure the Broward MPO’s attributable funds are used efficiently, MPO staff will modify the FY 2022-2026 TIP to utilize CARES (GFSU) funding allocated to projects in FY 2023 and FY 2024 for the amendments to the UPWP and replace the project funding shortfall with funding from the IIJA. Since CARES (GFSU) funding have already been authorized by FDOT and have a shorter funding obligation window (through September 30, 2024), MPO staff will utilize this funding for the more immediate UPWP need and allocate the new IIJA funding to the capital projects in FY 2023 and 2024 (which have a longer funding obligation window through September 30, 2025). This provides additional funding flexibility to those capital projects if unforeseen project delays arise. As a result, MPO staff proposes to amend the following projects in the FY 2022 TIP:

2. The Florida Department of Transportation Request to Add Five New Projects and One Phase to an Existing Project
FDOT is requesting to add two safety projects and three transit projects to the FY 2022-2026 TIP. The safety projects include advanced wrong way driving detection systems throughout Broward County and enhanced lighting at the intersection of Royal Palm Blvd. and Copans Rd. The transit projects provide Federal Transit Administration (FTA) Section 5310 Operation Assistance to private non-profit organizations providing transportation services to seniors and/or people with disabilities. This is part of the Coronavirus Response and Relief Supplemental Appropriations Act (CRRSAA) and the American Rescue Plan Act (ARPA) of 2021. Additionally, one environmental phase is being added to the Mobility Hub at Cypress Creek. Details for the six projects are presented below.
C. FM# 4495231 Advanced Wrong Way Driving (WWD) Detection Systems Broward County:
The project provides $500,000 ACSS funds to support a preliminary engineering (PE) phase to deploy wrong way detection (WWD) systems at seven high priority ramps located throughout Broward County. The seven locations include I-95 NB off ramp @ Hallandale Beach Blvd, I-95 SB off ramp @ Pembroke Rd, I-95 NB off ramp@ Pembroke Rd, I-95 SB off ramp @Oakland Park Blvd, I-95 SB off ramp @ W Broward Blvd/Access Rd, I-595 WB off ramp @ University Dr., and I-595 WB off ramp @ Davie Blvd/ SR 84.
D. FM# 4492821 SR-7/US 441 AT ROYAL PALM BLVD/COPANS ROAD:
The purpose of this project is to utilize the Safe Strides 2 Zero program, which enhances safety and mobility, utilizing the State Traffic Roadway and Intersection Data Evaluation System, in areas which are identified to have incidents and fatalities. This amendment adds $514,666 ACSS funds to fund a PE phase. The project improves lighting by installing additional light poles, relocating light poles, and upgrading existing high pressure sodium (HPS) lights to LED. The project also replaces the existing span wire signal support system with a mast arm system, installs additional signal heads so each travel lane has a signal head (NB & SB), installs a southbound right-turn lane, and extends the eastbound left turn-lane.
E. FM# 4504511 5310 ARPA – City of Pembroke Pines – Southwest Focal Point Senior Center:
The project provides City of the Pembroke Pines - Southwest Focal Point Senior Center with $346,940 5310 ARPA funds to support operating for fixed route.
F. FM# 4504541 5310 ARPA – Woodhouse Operating Assistance
The project provides Woodhouse Operating Assistance with $373,792 5310 ARPA funds to support operating for fixed route.
G. FM# 4504741 5310 CRRSAA – Henderson Behavioral Health, Inc.
The project provides Henderson Behavioral Health, Inc. with $210,780 5310 CRRSAA funds to support operating for fixed route.
H. FM# 435808-5 SR-9/I-95 MOBILITY HUB AT CYPRESS CREEK
The amendment requests $250 to support a new environmental phase for the project.

COMMITTEE RECOMMENDATION(S):
The Technical Advisory Committee recommended approval of the proposed TIP Amendments. For the Citizens' Advisory Committee, due to insufficient quorum a formal vote was not able to be taken, however a consensus was taken for the item to be approved.
