REQUESTED ACTION:

PUBLIC MEETING AND MOTION TO APPROVE Amendments to the 2045 Metropolitan Transportation Plan (MTP)

WHAT THIS ACTION ACCOMPLISHES:

As per Federal requirements, adding, deleting, or major changes to existing projects, funding, or language within an adopted MTP’s cost feasible plan require amendments to be made to that MTP. Approval of this item will allow the amendments described below to be formally adopted into the 2045 MTP.

SUMMARY EXPLANATION/BACKGROUND:

On December 12, 2019, the Broward MPO adopted its 2045 MTP, known as Commitment 2045. Consistent with Federal law (23 CFR § 450.104), any major changes to the MTP's cost feasible plan (project addition, project deletion, or significant changes to an existing project scope, cost, or implementation timeframe) require an MTP amendment. According to the Code of Federal Regulations, an amendment to the MTP "requires public review and comment and a redemonstration of fiscal constraint."

On June 11, 2020 the Broward MPO Board voted to amend the MPO Rules and established an annual MTP amendment cycle. The second annual 2045 MTP amendment request cycle closed on November 10, 2021. Three agencies (Port Everglades, Florida Department of Transportation [FDOT] District 4, and Broward County Transit [BCT]) submitted amendment requests. The Broward MPO also proposed amendments to the 2045 MTP. An overview of all amendment requests was provided at the December 1, 2021 Technical Advisory Committee (TAC) and Citizens' Advisory Committee (CAC) meetings as well as the December 9, 2021 MPO Board meeting. Following these presentations, BCT withdrew their amendment request on January 6, 2022. The formal withdrawal letter can be found in the Attachment. Additionally, FDOT District 4 and the Broward MPO mutually agreed to withdraw one MTP amendment request (I-95 @ Griffin Rd., MTP Roadway ID #10).

MPO staff reviewed the remaining amendment requests in accordance with the Florida LRTP Amendment Thresholds guidance document published by FDOT and the Federal Highway Administration to identify which projects would require a formal MTP amendment. A list of the final MTP Amendments can be found below:
  • Amend Description and Cost in the MTP – I-95 @ Hillsboro Blvd Project (Roadway Reference ID #2)
    • Description: from “I-95 @ Hillsboro Blvd” to “I-95 from South of SW 10th St. to N of Hillsboro Blvd”.
    • Cost: from “2024-2025: $402,971,000” to “2024-2025: $555,076,000; 2026-2030: $225,415,000”.
  • Amend Description and Cost in the MTP – SW 10th Street from W of Powerline Rd. to Hillsboro Blvd. Project (Roadway Reference ID #7)
    • Description: from “SW 10th Street from W of Powerline Rd. to Hillsboro Blvd” 
      to “SW 10th Street from FL TPK to W of I-95”.
    • Cost: from “2024-2025: $333,000”; 2026-2030: $333,000” to “2024-2025: $301,134,000; 2026-2030: $4,126,000”.
  • Amend the MTP to remove – Pembroke Road Widening from SW 160th Ave. to SW 184th Ave Project (Roadway Reference ID #43).
  • Amend the MTP to advance – Tri-Rail Rolling Stock Project (Transit Reference ID #5).
    • Advance: from “2036-2045 MTP Timeframe” to “2026-2030 MTP Timeframe”.
  • Amend the MTP to include – fifty (50) projects from the Port Everglades most recently adopted 2018 Master/Vision Plan Update. (MTP Page 5-35)
The proposed amendments will have no impacts on the fiscal constraint of the 2045 MTP cost feasible plan.

MPO staff determined the remaining revisions do not require an Amendment but rather can simply be incorporated as part of an MTP administrative modification consistent with the above published guidance for LRTP amendment thresholds and Federal law. Administrative modifications include minor changes to project scope, cost, initiation dates, or narrative revisions and do not require public review/comment or a redemonstration of fiscal constraint, and allow MPO staff to revise the MTP accordingly without action from the MPO Board. For transparency purposes, a list of the MTP modifications are provided below:
  • Modify the MTP to advance – SW 148th Ave from Bass Creek Rd. to Miramar Pkwy widening project (Roadway Reference ID #51).
    • Advance: from “2031-2055 MTP Timeframe” to “2026-2030 MTP Timeframe,” consuming the funding gap left by the removal of Roadway Reference ID #43 (see above)
  • Modify the MTP to remove – West Dania Beach Blvd Corridor Improvements Project from the Unfunded Project List (Roadway Reference ID#77)
  • Modify the MTP to incorporate – Public Transportation Agency Safety Plan Measure (PTASP) narrative and adopted targets. (MTP Page 6-9)
  • Modify the MTP to add – “supporting infrastructure for Automated, Connected, Electric, Shared (ACES) technology” to the TSM&O/Safety Program description. (MTP Page 5-6)
The proposed MTP amendments (listed above) were advertised in the Sun Sentinel and El Sentinel (Spanish) consistent with the minimum 45-day advertisement period for MTP amendments specified in the Broward MPO's Public Participation Plan. In addition, the Amendments and modifications have also been included using red text in Chapters 5 and 6 of the proposed amended MTP document. Both the newspaper advertisement and draft amended 2045 MTP document can be found at: www.commitment2045.org.

Per Federal regulations, a public review and comment period is provided for the amendments listed above. Opportunities for the public to speak will be provided at the February 23, 2022 meetings of the TAC and the CAC as well as at the March 10, 2022 MPO Board meeting. MPO and agency representatives will be available at the meetings to answer any questions and address comments.

COMMITTEE RECOMMENDATION(S):

The Technical Advisory Committee recommended approval of the Amendments to the 2045 MTP. For the Citizens' Advisory Committee, due to insufficient quorum a formal vote was not able to be taken, however a consensus was taken for the item to be approved.

MPO STAFF RECOMMENDATION(S):

MPO staff recommends approval of the Amendments to the 2045 MTP.
