REQUESTED ACTION:
PUBLIC MEETING AND MOTION TO RECOMMEND BROWARD MPO APPROVE an Amendment to the 2045 Metropolitan Transportation Plan (MTP)
A. Amend Scope and Description in the MTP – SR 869 (Sawgrass Expwy) Project from MP 18 - US 441/SR-7 to MP 22 - Powerline Rd (Reference ID #15)
WHAT THIS ACTION ACCOMPLISHES:
As per federal requirements, adding, deleting, or major changes to existing projects, funding, or language within an adopted MTP’s cost feasible plan require amendments to be made to that MTP. Approval of this item will allow the amendment described below to be formally adopted into the 2045 MTP.
SUMMARY EXPLANATION/BACKGROUND:
On December 12, 2019, the Broward MPO adopted its 2045 Metropolitan Transportation Plan (MTP), known as Commitment 2045. Consistent with federal law (23 CFR § 450.104), any major changes to the MTP's cost feasible plan (project addition, project deletion, or significant changes to an existing project scope, cost, or implementation timeframe) require an MTP amendment. According to the Code of Federal Regulations, an amendment to the MTP "requires public review and comment and a redemonstration of fiscal constraint."
On June 11, 2020 the Broward MPO Board voted to amend the MPO Rules and established an annual MTP amendment cycle. The first annual 2045 MTP amendment request cycle closed on November 10, 2020. One agency (Florida's Turnpike Enterprise [FTE]) submitted an amendment request to revise the descriptions for five existing projects in the MTP cost feasible plan. MPO staff reviewed the amendment requests in accordance with the Florida LRTP Amendment Thresholds guidance document published by the Florida Department of Transportation and Federal Highway Administration and determined that only one project revision constituted a major scope change and would require an MTP amendment:
MPO staff determined the remaining four project revisions are not a major scope change and do not require an Amendment but rather can simply be incorporated as part of an MTP administrative modification consistent with the above published guidance for LRTP amendment thresholds and federal law. Administrative modifications include minor changes to project scope, cost, or initiation dates, do not require public review/comment or a redemonstration of fiscal constraint, and allow MPO staff to revise the MTP accordingly without action from the MPO Board. For the FTE administrative modifications being made to the 2045 MTP, please see Attachment 1. In support of these modifications, FTE has provided a fact sheet outlining the definition of a managed lane which can be found in Attachment 2.
In addition, for transparency purposes, Broward MPO staff is also making an MTP administrative modification to the Complete Streets Master Plan Funding Program to include language allowing for greater flexibility of the use of the existing MPO attributable funds currently allocated to the Funding Program. This will allow the Broward MPO to leverage MPO attributable funding on state resurfacing projects and enhance the regional bicycle and pedestrian network. These projects will be clearly identified in the MPO’s Multimodal Priorities List.
The proposed MTP amendment (listed above) was advertised in the Sun Sentinel, El Sentinel, and South Florida Times beginning December 10, 2020 consistent with the minimum 45-day advertisement period for MTP amendments specified in the Broward MPO's Public Participation Plan. In addition, the Amendment and modifications have also been included using "strikethrough-and-underline" text in the existing 2045 MTP document. Per federal regulations, a public review and comment period is provided for the amendment listed above. Opportunities for the public to speak will be provided at the January 27, 2021 meetings of the Technical Advisory Committee and the Citizens’ Advisory Committee as well as at the January 28, 2021 MPO Board meeting. MPO and Turnpike staff will be available at the meetings to answer any questions.
