3. Public Comments. Any person with business before the Commissioner’s Court not scheduled on the agenda may speak to the Court. No formal action can be taken on these items at this meeting. Comments regarding specific agenda items should occur when the item is called. There is a 2 minute speaking limit.

4. Discussion and/or action to approve Carrie Rice to the Burnet County Child Welfare Board (Oakley)

5. Discussion and/or action concerning potential uses of the Agri Life building (Oakley)

6. Discussion and/or action to accept the donation of $1,000.00 from Cooper Equipment Co. to Burnet County for our Professional Development/Healthy County day (Smith/Oakley)

7. Discussion and/or action to accept additional funding of $9,639.95 and sign Inter-local contract for FY 2020 Next Generation 9-1-1 database program for $99,624 from Capital Area Emergency Communications District to coordinate implementation and collection of the Geographic Information System on a countywide basis in accordance with the standards adopted for the Capital Area Council of Governments GIS Program. Date of new contract is 4/1/2020 – 9/30/2020 (Smith/Oakley)

8. Discussion and/or action for the approval to apply for the County Essential Services Program grant from Office of the Governor for the prosecution costs for the triple capital murder trial in San Saba County. As administrative county for the 33rd and 424th Judicial Districts and San Saba County’s single employee financial department, Burnet county will take the lead on the administration of this grant (McAfee/Smith)

9. Discussion and/or action for the approval of out of state travel to Georgia for Kristen Davis to attend mobile device investigations program. Expenses include airfare, baggage fees, meals and transportation to class – estimated amount $1,166.40 (Dillard/Smith)

10. Discussion and/or action regarding approval to use county manpower and equipment to assist the Burnet County Rodeo Association in preparation for their annual fundraiser event at the Burnet County Rodeo grounds (Beierle)

11. Discussion and/or action regarding the request to waive late penalty fees from Kathleen Stearns LaSeu (Oakley)

12. Discussion and/or action concerning additional early voting locations for future elections (Oakley/Ferguson)

13. Discussion and/or action concerning future Burnet County Elections to utilize Countywide Polling style voting, also known as Vote Centers. This method allows for voting at any polling location on Election Day (Oakley/Ferguson)

Judge Oakley called the meeting to order at 9:00 a.m.

Invocation and Pledge of Allegiance to the Flags
Commissioner Damon Beierle gave the invocation.  The court led the pledges to the U.S. and Texas flags.

There were no comments from the public.
 
Item #25
Acknowledgement of Receipt
Florence Reeves, Library Director Herman Brown Free Library, offered to the County a signed copy of a Johnny Cash book dedicated to the Burnet Texas Library in memory of Sheriff Wallace Riddell, dated February 24, 1978.  The book will be displayed at the Historic Jail, along with other Riddell items, once it is completed.
 
Item #12:
Early Voting Locations
The court discussed additional early voting locations for future elections.  Judge Oakley noted the increase of wait times at voting locations, stemming from area growth resulting in greater voter turnout.  The Judge does not want this to become a deterrent to voters. The court would need to decide which locations and elections will use the additional early voting locations.  Discussion included using the Granite Shoals Fire Department and Bertram Library.  Future discussions will address if the additional locations for early voting will be used for the Primary or only the General Elections.  Judge Oakley inquired what the additional costs would be to add the two locations.  Doug Ferguson, Elections Administrator, estimated each location would cost approximately $5,000 to $6,000 dollars to operate per election.  If approved, the court would need to increase the budget for Fiscal Year 2021.  Comm. Beierle, asked if each location would have the same days and hours of operation.  Mr. Ferguson answered yes, the law states all early voting locations must follow the same patterns.  Eddie Arredondo, County Attorney, advised if this action is passed it is subject to it being appropriated by the Commissioners Court for that budget year.  Comm. Dockery's concern is the financial impact.  Once these additional early voting locations are added it will remain the standard going forward.  The court then discussed if there is a need for the additional voting locations during the primary elections.  Mr. Ferguson did not think the trends support this need just yet.  Judge Oakley's concern is by not being open for both types of elections, this may lead to confusion and frustration by the public.
 

Motion is made by: Commissioner Precinct 1 Jim Luther, Jr., Seconded by: Commissioner Precinct 3 Billy Wall to approve two additional early voting locations for the November 2020 General election. This motion includes the fiscal aspect of twelve thousand dollars budgeted for FY 2021.

After the motion, Comm. Beierle asked the opinions of any party leaders in attendance. Kara Chasteen, Republican Party Chair, stated she was in favor of this agenda item. Marti Pogue, Democratic Party Chair, stated she was very much in favor of this agenda item. Additionally, Mr. Arredondo reiterated when stating the fiscal aspect of budgeting for it, if the court does not budget for the additional locations, the additional early voting locations will not happen. Judge Oakley replied as the court votes today, that is a part of the budget build.

Vote Centers for
Burnet County Elections
The court discussed action concerning future Burnet County Elections to utilize Countywide Polling style voting, also known as Vote Centers.  This method allows for voting at any polling location on Election Day.  Judge Oakley and Doug Ferguson, Elections Administrator, have discussed this during past election cycles.  Comments were heard from the public.  Marti Pogue, Burnet County Democratic Party Chair, is in favor of Countywide Polling style voting.  Kara Chasteen, Burnet County Republican Party Chair, is also in favor of this item.  Tommy Gott, former presiding judge for Precinct 2, commented how this will make it easier for the public to vote. 

Mr. Ferguson stated, ultimately this will need to go to the State for approval.  There are requirements from the State before Burnet County can utilize Vote Centers.  One criterion is testing the connectivity at all voting locations and having a backup plan if the connectivity fails.  Another is holding a scheduled town hall meeting for the public which needs to be recorded and submitted to the State.  The deadline to submit the required criteria for approval for the next Election is August 5, 2020.

Department Updates
Doug Ferguson, Elections Administrator, reported on the March 2020 Primary election.  Mr. Ferguson provided additional equipment for each location in the event of a malfunction.

The court discussed the Replat of Lots 6 and 7, The Center Cove at Windermere, Sec. II, a subdivision in Burnet County as shown on the Plat recorded in Cab. 1, slide 131B.  Herb Darling, Director Burnet County Development Services, explained there was verbal acknowledgement, but no plat signed from the POA.  He asked the court to approve the item today with Judge Oakley's signature and the Commissioners to sign later.  
 

Motion is made by: Commissioner Precinct 4 Joe Don Dockery, Seconded by: Commissioner Precinct 1 Jim Luther, Jr. to approve the Replat of Lots 6 and 7, The Center Cove at Windermere, Sec. The court discussed FCC licensing topics for jail operations.  The Sheriffs Department is in the process of acquiring new licenses in order to be in compliance.

Child Welfare Board
The court discussed approving Carrie Rice to the Burnet County Child Welfare Board.

Agrilife Building
The court discussed potential uses of the Agrilife building.  Judge Oakley was approached by a small area church if the Agrilife building would be available on Sundays each week.  The court discussed this could become a conflict with other scheduled events.

Cooper Equipment Co.
The court discussed approval to accept the donation of $1,000.00 from Cooper Equipment Co. to Burnet County for our Professional Development/Healthy County day.  This donation will be used to provide lunch for the event.

The court discussed the request to waive late penalty fees from Kathleen Stearns LaSeu.  Comm. Dockery has spoken with the County Attorney's office about preparing a formal letter in response to these requests.  They are currently preparing this letter.

Item #24:
Department Updates
The court discussed department updates.  

Karrie Crownover, Burnet County Treasurer, presented the Treasurer's report for the 1st Quarter Investments Report and the January 2020 Report.

Andi Ball, County Tourism Director, updated the court regarding the media tour.  There were a total of 15 journalists from throughout the United States and Canada.  Ms. Ball stated the tour was extremely successful.

Comm. Dockery updated the court on the Homeland Security Grant.  The grant submitted in the amount of $277,000 to outfit the Mobile Command Trailer was not approved.  The court will need to look to other financial resources to outfit the trailer.  

Judge Oakley updated the court on the March 9, 2020 Capital Area Metropolitan Planning Organization (CAMPO) meeting.  He was informed of the decision made to defer several transportation projects across the state, including Burnet County.  Judge Oakley stated his discontent with this decision, as it had been communicated to the public these projects would be forthcoming.  CAMPO will be meeting again in April where projects will be up for discussion.  Comm. Dockery stated for the record his displeasure with these decisions the Transportation Commission has made.  

Calvin Boyd, Burnet County Sheriff, updated the court of animal control being the biggest issue at the moment.  Two mass gathering permits have been requested: a Spartan race and an 2-day event at the Spicewood Vineyard.  The Burnet County Jail should be having an inspection within the next couple of weeks.  He stated in the past three years inspections, the jail has done well.  Both Judge Oakley and Sheriff Boyd stated Deputy Kimbler does a great job at the Jail.  There is still the issue with the showers, however they have currently been patched.  Judge Oakley asked what is the status on the RFP.  Karin Smith, Burnet County Auditor, stated her office is currently working on rebuilding the file to open the RFP for the repairs.  Sheriff Boyd informed the court there will be a staffing study taking place in the near future to ensure the jail is compliant with the number of staff.

Herb Darling, Director Burnet County Development Services, stated his office remains closed after 12:00 p.m. on Fridays to allow them to continue working on rebuilding files allowing them to make progress.

Judge Oakley noted within the line item transfers, funds are being moved for the purchase of a K9 trailer found on the state surplus site.  This would allow for a staging spot for animals picked up after hours to be held overnight and then taken to the facility at one time.  This will save on after hour expenses.  
 

Motion is made by: Commissioner Precinct 1 Jim Luther, Jr., Seconded by: Commissioner Precinct 4 Joe Don Dockery to approve the consent agenda in its entirety.

Vote: 5 - 0 Passed - Unanimously
