Comm. Wall led the Court with the Invocation and Pledges to the United States and Texas Flags.

There were no comments from the public.

Item #1 Addendum:
Precinct 19 Second Voting Location
at City Of Meadowlakes, City Hall

The Court discussed the City of Meadowlakes, City Hall, as a second precinct 19 voting location. Doug Ferguson, Elections Administrator, was contacted by the Secretary of the State requesting a map of Polling locations. Election Code Section 43.007 states the number of County Wide polling locations within a Commissioner's Court Precinct may not exceed more than twice the number in another Commissioner's Precinct. There are 7 locations in Precinct 1 and only 3 locations in Precinct 4. An additional polling location in Precinct 4 is needed to qualify Burnet County as a Vote Center. After speaking with the City Manager of Meadowlakes, Mr. Ferguson was able to obtain the use of City Hall as an additional polling location.

The Secretary of State's Office told Mr. Ferguson, the application to be a Vote Center looks favorable. Mr. Ferguson anticipates having a decision today regarding the approval of Burnet County as a Vote Center. Once Mr. Ferguson has been notified of the approval, the Elections Office will begin sending notification out to all registered voters regarding Vote Centers. On the reverse side of the flyer, there will be information on safety precautions the County will have in place resulting from COVID-19.

Department Updates

Doug Ferguson, Elections Administrator, gave an update regarding the Elections Department. Mr. Ferguson continues to receive supplies for the election and needs additional storage to hold these items. There has been increased activity with requests for ballot by mail activity and voter registration. Mr. Ferguson also went over the process for voting by mail.

Spring Creek Estates

The Court discussed the replat of Lots 9A and 10A, Spring Creek Estates to be known as Lots 9B and 10B, Spring Creek Estates.

County Employees Fundraiser

Janet Parker, County Clerk, and her department presented checks on behalf of County Employees to area food banks. Checks in the amount of $834.00 were awarded to the Helping Center of Marble Falls, La Care of Burnet, Bertram Food Pantry, and Joseph's Food Pantry.

Dockal Ranches

The Court discussed the final plat of Dockal Ranches, Phase 2, a private subdivision consisting of 39 lots on 82.24 acres located on 82.24 acres located in the 6100 block of E. FM 243. Les Thomas, property owner across from the subdivision, has concerns regarding drainage once it reaches his property. He is asking the Court to have an engineering study done for additional research. Herb Darling, Development Services, states the Developer has complied with all the requirements of the State, which includes drainage studies and any mitigation required. Judge Oakley stated the Court does not have any latitude in this matter as the developer has met the criteria.

The Court discussed the authorization of the purchase of a computer for Constable Pct. 3, from Justice of the Peace Pct. 3’s, Technology funds in the amount of $1,569.23 if determined that the purchase serves as technological enhancement for the justice court. Precinct 3 Jane Marie Hurst, Justice of the Peace and Chip Leake, Constable were present to answer any questions from the Court. Comm. Luther inquired what the enhancement is for. Judge Hurst explained Constable Leake is in need of a computer. Judge Hurst is requesting a camera and microphone for her existing computer in order for her to attend Zoom meetings and court hearings.

The Court discussed a variance from the Burnet County Subdivision Regulations by Johnny and Denise Gray for a 2.5 acre tract out of 35 acres (BCAD parcel #56487) located in the 10000 block of CR 200. Any future requests for variances would require them to go through the platting process.

The Court discussed the setting of the 2021 Sheriffs’ and Constables’ Fees. Janet Parker, County Clerk, presented the proposed changes. Service and posting fees remain the same.

Item #6:
Mack Dump Trucks

The Court discussed the purchase and buyback of Mack Dump Trucks. Karin Smith, County Auditor, stated two trucks were purchased the prior year with a guaranteed buyback. There is the option to keep the trucks or they will purchase them back if the Court chooses.

Motion is made by: Commissioner Precinct 2 Damon Beierle, Seconded by: Commissioner Precinct 3 Billy Wall to exercise the option to purchase new trucks and buyback for Precinct 2 and Precinct 3.

Vote: 5 - 0 Passed - Unanimously

Motion is made by: Commissioner Precinct 4 Joe Don Dockery, Seconded by: Commissioner Precinct 1 Jim Luther, Jr. to select the lease purchase of dump trucks for Precinct 1 and Precinct 4.

The Court discussed the “Amending Plat of Ranch 142, River Hills Ranches, Phase Two-A, A private subdivision, Burnet County, Texas” to correct a scrivener error found in the acreage shown on the recorded plat of “River Hills Ranches, Phase Two-A, A private subdivision, Burnet County, Texas” recorded in Co. No. 202008356, OPR, Burnet County, Texas. The correct acreage is 5.12 acres. There was an error in the calculation of total acres.

2021 Sheriffs' & Constables' Fees

The Court discussed the setting of the 2021 Sheriffs’ and Constables’ Fees.

The Court took no action on this agenda. The Court would like to see existing fees compared to the proposed fee changes.

Item #7:
Deferral of Employee Payroll Taxes

The Court discussed the Presidential Memorandum allowing the deferral of employee payroll taxes for the period of 9/1 – 12/31/2020. Sara Ann Luther, Human Resources Director, said the Treasury Department was instructed to provide guidance, which has not taken place at this time. As it is unclear to Human Resources how to manage the memorandum, Ms. Luther requests to hold off on a decision until further guidance has been provided by the Treasury Department. Karin Smith, County Auditor, clarified today's decision is not whether we participate. There is payroll which needs to be processed at this time. The financial system is not prepared yet to handle the changes and the Treasury Department has not issued guidance.

COVID-19 Virus

The Court discussed topics related to the COVID-19 Virus.

Sara Ann Luther, Human Resources Director, addressed the topic of work from home guidelines and infrastructure. There is a request from Linda Bayless, Court at Law Judge, requesting the Court provide internet service for the Court Reporter. Currently, Judge Bayless' Court Reporter is working from home, however her internet does not satisfy the needs of what the job entails and exceeds her current data plan. Consideration is being given to utilize CARES Act funds to rectify the situation. Judge Oakley explained COVID funds may not be encumbered for an annual contract on a hotspot as it goes beyond the window of the CARES Act funds. Prior to this request, a hotspot was acquired to be used on the employees data plan on a 'pay as you go' basis. There was hesitation on the part of Judge Oakley and Karin Smith, County Auditor, as the Courthouse was open at the time. A line-item transfer, from Judge Bayless' budget, was done to acquire a hot spot with a defined data plan. That got burned up pretty quickly. Judge Oakley brought this topic to the Court for further discussion. Ms. Luther stated Burnet County does not have a work from home policy. The Court discussed offering infrastructure at an employees home in order for them to perform their job function. Ms. Luther is concerned this may set a precedent for other employees looking to work from home. The Court stated the tools to support employees job function is being provided at the Courthouse. Comm. Dockery & Comm. Luther questioned why an employee can't come to the courthouse to work? Comm. Wall questioned the elected official paying for these types of request out of their own budget? Ms. Smith, reports there are no funds in the County Court at Law 2021 Budget to support this request. Ms. Smith stated we need to be consistent in how we are going to handle all of the request from employees that want to work from home and to what extent is the county going to provide personal internet in employees homes. Judge Oakley questioned do we provide infrastructure in homes when the courthouse is open and has wi-fi? Comm. Dockery stated his policy is the courthouse is here physically and has the support system here. Comm. Bierele feels we should not set up infrastructure outside of the courthouse for someones' convenience. Ms. Smith suggests a policy be created to address work from home.

Motion is made by: Commissioner Precinct 2 Damon Beierle, Seconded by: Commissioner Precinct 4 Joe Don Dockery to not offer duplicate infrastructure for employees who choose to work from home.

2020-2021 Budget

Judge Oakley opened the Public Hearing on the 2020-2021 Budget. There were no comments from the public.

Karin Smith, County Auditor, added within this item is the County Clerk and District Clerk's records management plan. Janet Parker, County Clerk, discussed the archival plan for next year. Within the proposed budget, the County Clerk Records Archive page shows a deficit of $49,000.00. Ms. Parker wants to assure the Court there will not be a deficit. As of June 30th, in both the County Clerk Management and Records Archive funds there is a total of $410,000.00 with revenue coming in continuously every month into both funds.

2020-2021 Budget

The Court discussed the 2020-2021 Budget and take action as necessary.

Judge Oakley stated there is a change to the budget. Changes in Library systems subscriptions resulted in a $15.00 increase in license and support fees. Funds were moved internally by reducing operating supplies in the amount of $15.00.
