Proclamation
Burnet County Hunger Alliance Month
Kathy Nicholl, Burnet County Hunger Alliance, gave a presentation to the Court.  The Court passed a Proclamation designating September as Hunger Awareness Month and September 21-27 as Hunger Awareness Week.
 

Motion is made by: Commissioner Precinct 4 Joe Don Dockery, Seconded by: Commissioner Precinct 2 Damon Beierle to adopt a Proclamation designating September 2020 as Burnet County Hunger Awareness Month and September 21-27 as Hunger Awareness Week.

Vote: 5 - 0 Passed - Unanimously

Donation to
Bertram Library
The Court discussed accepting 10 hot spots from the Tocker Foundation to be utilized by the Bertram Library.  Ann Brock, Director Bertram and Oakalla Libraries, introduced her successor, Mary Seaman.  The total number of hot spots received is 15. Service is provided for one year and may be checked out for use by library patrons.  
 

Motion is made by: Commissioner Precinct 3 Billy Wall, Seconded by: Commissioner Precinct 1 Jim Luther, Jr. to accept 15 hot spots from the Tocker Foundation to be utilized by the Bertram Library.

Item #22:
Proposal
Water Management System
The Court discussed a proposal for a water management system at the county jail.  The mechanism will regulate the amount of water being used in showers and restrooms, which will conserve water and reduce costs.  Karin Smith, County Auditor, explained this being a bid the Court needs to award the bid to ICS for the negotiated rate and then it will need to come back to the Court for a contract.
 

Motion is made by: Commissioner Precinct 2 Damon Beierle, Seconded by: Commissioner Precinct 1 Jim Luther, Jr. to award the bid to ICS for the negotiated rate for the water management system.

Vote: 5 - 0 Passed - Unanimously

Comm. Luther noted the system does not hinder the use of water, but the abuse of it.  Judge Oakley added this will keep the Jail in compliance with jail standards.
 
Item #15:
Action/ Discussion
COVID-19 Virus
The Court discussed items related to the COVID-19.

At the Burnet County Jail, employees worked additional shifts due to the COVID outbreak.  To recognize employees, Matt Kimbler, Captain, suggested the purchase of a popcorn popper and snow cone machine.  Karin Smith, County Auditor, stated this is to show appreciation to jail staff during the COVID pandemic.
 

Motion is made by: Commissioner Precinct 3 Billy Wall, Seconded by: Commissioner Precinct 2 Damon Beierle to purchase a popcorn and snow cone machine for the jail staff in the amount of $622.54.

Vote: 5 - 0 Passed - Unanimously

Item #26:
Department Updates
Matt Kimbler, Captain, gave an update on the Burnet County Jail.  Work continues to extend power to the new barn.  Currently, there are no cases of COVID at the jail.  The intake policy of new inmates has been modified.  They received their new intake screener for Jail staff, which will notify Mr. Kimbler if someone fails the screening.

Call for Bids
Requests for Proposals/ Qualifications
The court discussed going out for bid to allow construction for reconfiguration of the booking area project at the Burnet County Jail.
 

Motion is made by: Commissioner Precinct 4 Joe Don Dockery, Seconded by: Commissioner Precinct 3 Billy Wall to go out for bid to allow construction for reconfiguration of the booking area at the Burnet County Jail.

Vote: 5 - 0 Passed - Unanimously

Comm. Dockery asked if there was an estimate and where it will be funded from.  Judge Oakley responded the first quote was for $48,000.00 which does not include bonding.  This will be funded by using COVID related funds. Karin Smith, County Auditor, clarified the funding is part of COVID funds, but through CAPCOG which has not been officially approved.  Mr. Kimbler said as the scope of work has changed from the bid originally received, the cost should be lower than the original bid.

Department Updates
Deanne Fisher, County Treasurer's Office, presented the Treasurer's Report for June, July, and acceptance of Quarterly Investment Report 3rd Qtr.
 

Motion is made by: Commissioner Precinct 4 Joe Don Dockery, Seconded by: Commissioner Precinct 1 Jim Luther, Jr. to accept the Treasurer's Report for June, July, and acceptance of Quarterly Investment Report 3rd Quarter.

Vote: 5 - 0 Passed - Unanimously

Susan Patten, from the LCRA was present.  Judge Oakley reported to the Court she has offered to assist with morning leadership meetings.  They are currently looking for a venue suitable to all attendees. 

Herb Darling, Development Services, gave an update on his department.  His office remains busy and continues to see a great deal of growth.  Janet Parker, County Clerk, agreed adding the number of documents being filed in her office has increased.  

Ms. Parker gave an update on her department.  The remodel continues in the Clerk's office.  Once the majority of work has been completed, she will reopen to customers.  If glass has not been installed, she will set up the plexiglass at each workstation.  Currently, the public is unable to enter for research as it is unsafe to enter the office.  Ms. Parker submitted a budget amendment to pay the invoice from Aumentum for loading the indexes and images into our software.  This is a one time fee of $7600.00.  All Deeds, Deeds of Trust, and Oil Gas and Mineral Records will be available to the public.  The Property Fraud Alert has been very well-received by property owners.  There are approximately 1000 property owners who have registered.  The Clerk's office has reached out to the Title Companies in Burnet County to make homeowners aware of the program.  Businesses are also able to register for alerts under a Business name.  Ms. Parker has offered to make a presentation to any groups, such as POA's and HOA's, who would like more information regarding the program.  The Clerk's office has received positive feedback regarding the Property Fraud Alert Program.  

Mike Cummings, Chief Deputy, reported the Maintenance Department is putting the finishing touches on the Dispatch area.  Judge Oakley said maintenance needs to finish the Clerk's office first before continuing with other projects.

2021 Mack Dump Trucks
The Court discussed the contract with Bancorp South to finance 1 or more 2021 Mack Dump Trucks.  Karin Smith, County Auditor, stated this is financing for the dump trucks which were previously approved.  The interest rate will be 2.34% for 13 months.
 

Motion is made by: Commissioner Precinct 2 Damon Beierle, Seconded by: Commissioner Precinct 3 Billy Wall to approve the contract with Bancorp South to finance 1 or more 2021 Mack Dump Trucks.

Refinance/ Refund
Exisiting Bonds/ Tax Notes
The Court discussed the opportunity to refinance/refund existing bonds/tax notes to potentially save over $900,000 collectively over the life of each term.  Judge Oakley stated the Court is looking for a discussion and action to move forward, this is not the final approval.  Karin Smith, County Auditor, said this would be placed on the agenda for October 13 to approve the refunding bonds.  This would allow Duane Westerman the ability to begin drafting the proposals to move forward when the market is favorable.  
 

Motion is made by: Commissioner Precinct 3 Billy Wall, Seconded by: Commissioner Precinct 1 Jim Luther, Jr. to approve action to move forward with the refinance/refund of existing bonds/tax notes.

The Court discussed a utility easement for the City of Burnet at the Burnet County Jail property.  This easement will allow the City of Burnet to install power poles to provide power to the barn.  The easement has been identified by survey and recorded.

2020 Redistricting
The Court discussed 2020 redistricting.  This item was previously approved in September 2019. Karin Smith, County Auditor, explained this item has returned to Court for approval to authorize $5000.00 payment of the retainer and acknowledging the $25,000.00 cost.
 

Motion is made by: Commissioner Precinct 1 Jim Luther, Jr., Seconded by: Commissioner Precinct 3 Billy Wall to approve 2020 Redistricting payment to Allison, Bass, & Magee, LLP in the amount of $5000.00 and acknowledging the $25,000.00 total fixed fee.

COVID-19 Virus
Judge Oakley reported the numbers are trending down.  At one point, there were 33 active cases, but that has since increased. He did not have a current number of cases as of this morning. Judge Oakley spoke with Dr. Juliette Madrigal, Burnet County Health Authority, and discussed a minor resurgence of cases.  If the County's active cases falls to the threshold of 20, there will be an opportunity to seek an exemption from the Governor's mandate.  The Auditor's Office is currently in the process of recouping funds from the CARES Act for expenditures related to COVID-19.

Judge Oakley addressed the matter of an outstanding invoice for an estray.  Comm. Luther informed the Court there was one invoice remaining to be paid.  It was determined by the Commissioners the invoice should be paid out of funds from the Sheriff's Department.
 

Motion is made by: Commissioner Precinct 1 Jim Luther, Jr., Seconded by: Commissioner Precinct 4 Joe Don Dockery to authorize the payment of the final claim of the vendor and the funds be derived from the Sheriff's Office budget.

Karin Smith, County Auditor, stated the Court can discuss this item, but may not take action.  The item will be placed on a future agenda.  Comm. Dockery and Comm. Luther withdrew their motion and second.

The Court discussed the Pitney Bowes postage machine lease for the courthouse, Circle S Pest Control Services, G Suite Business Account for Google services for Sheriff’s office, Contract labor agreement with Maldonado Construction to pour concrete at the gun range, and Amendment of the Inter local agreement with the City of Burnet for road work.
