Judge Oakley called the meeting to order at 9:00 a.m.

Commissioner Dockery, Precinct 4, led the court in Invocation and Pledge of Allegiance to the Flags.

There were no comments from the public.

Herb Darling, Development Services, stated that a re-plat that was approved in the previous meeting had the wrong copy signed by the Judge and requested that the correct one be signed for the surveyor.

The Court took no action on this agenda item.

The court discussed the final plat approval of Shin Oak Bend, a private subdivision consisting of 47 lots on 227.30 acres located in the 6000 block of CR 252.

The court discussed a certificate for Capital Area Housing Finance Corporation. Judge Oakley spoke, informing the court that Burnet County has not taken action to not allow them to proceed with this.

The Court discussed FY 23 Burnet County Longevity Policy. Karin Smith, County Auditor, stated that this allows what was approved last year for full-time employees and adding part-time employees. Judge Oakley spoke saying this is adding part-time employees.

The court discussed payment for Jail/Sheriff’s Office employees working mandatory dispatch overtime for the period ending 12/30/22. Sara Ann Luther, HR Director, spoke saying this is a unique situation as the Sheriff's Office is short on employees and has had other employees that are not in dispatch covering shifts. Ms. Luther, said the employees did not realize since this was a lower position on the payscale, that they were not getting paid overtime for their regular positions. Judge Oakley spoke saying these positions are limited to just employees that are certified to be able to fulfill the requirements of the position. 

Motion is made by: Commissioner Precinct 2 Damon Beierle, Seconded by: Commissioner Precinct 3 Billy Wall to approve payment for Jail/Sheriff’s Office employees working it is mandatory dispatch overtime for the period ending 12/30/22.

The court discussed updating the Employee Handbook, Section 3.6 (Timekeeping). Sara Ann Luther, HR Director, informed the court there had been employees short of their 40 hour work week and the treasurer's office was confused as if they wanted to use time or if they wanted to be short for that pay week. Ms. Luther asked to strike out at the top of the section code 3.6 that employees will be paid 10 hours less if they do not turn in their time sheets. 

Motion is made by: Commissioner Precinct 4 Joe Don Dockery, Seconded by: Commissioner Precinct 1 Jim Luther, Jr. to approve updating the Employee Handbook, Section 3.6 (Timekeeping). Commissioner Dockery, requested to amend his motion adding to remove the policy that if you do not turn in your time sheet you will have 10 hours removed from your pay.

The court discussed previous agenda items. Judge Oakley, spoke saying they had received a resignation letter from Constable Pricint 3. There was a letter received 2 weeks ago and the position was posted but Constable Precinct 3, already turned in his keys and will not be fulfilling his duties until the end of October. 

The court discussed extending the exception allowing Telecommunicators to carry over 160 hours of vacation on 12/31/22. Sara Ann Luther, HR Director, informed the court given the circumstances these employees do not have opportunities to use a lot of time, but their time builds up and they lose it if it's not used.

Motion is made by: Commissioner Precinct 2 Damon Beierle, Seconded by: Commissioner Precinct 4 Joe Don Dockery to approve extending the exception allowing Telecommunicators to carry over 160 hours of vacation on 12/31/22.

Commissioner Beierle, Precinct 2, asked for an update on the salary survey that was completed with Evergreen. Judge Oakley stated for clarification that is was not just a salary survey, it was a position survey as well as a work chart. Sara Ann Luther, HR Director, spoke and said she spoke with the company 2 weeks ago and had responses from entities and are collecting the data that has things in common with how Burnet County is set up. Ms. Luther said that the changes should be implemented in the FY 24 Budget. 

The court discussed acceptance of a $100,000 award from the US Department of Treasury Local Assistance and Tribal Consistency Fund. Judge Oakley spoke saying this will be spread out over a 2 year period. Karin Smith, County Auditor, informed the court that this is part of the ARPA Act and Burnet County is receiving this because the county participates in Lieu of Taxes Program administered by the Fishing Wildlife Services.

The court discussed switching Paul Shanks from a paid driver to a volunteer driver for VetRide Program. 

Motion is made by: Commissioner Precinct 1 Jim Luther, Jr., Seconded by: Commissioner Precinct 2 Damon Beierle to approve switching Paul Shanks from a paid driver to a volunteer driver for VetRide Program.

The court discussed a burn ban for the unincorporated areas of Burnet County. Judge Oakley, said it had not rained in awhile. Commissioner Beierle, Precinct 2, said that the Fire Chiefs that he had spoken with believed that it was time to put a ban in effect.Commissioner Dockery, Precinct 4, spoke saying the number as of today was 586.

Judge Oakley, informed the court that Travis County Commissioners Court approved a 10 percent increase to their fees for the Travis County Medical Examiner and the fee is due to increases in the operations of their office.

The court discussed department updates. Herb Darling, Development Services, informed the court that he lost an employee as she moved to another position within the county and his office is about 2 weeks out on turn around. Judge Oakley spoke saying the modular building for the Public Defenders Office is in preparation and they are working on the parking lot as well as other items. Judge Oakley said that maintenance will be working on the south annex for the Tax Assecor Collectors Office.

a. Award of bid for the electrical work at the Sheriff’s Office, as well as the contract labor agreement with Schmidt Electric Co., for the work to be performed.

Judge Oakley spoke on item a, and the county received a submittal from Schmidt Electric in the amount of $49,599.00
