Consideration of Contract: Lockett Road Corridor Study Project

RECOMMENDED ACTION:

Rescind the award of contract from February 7, 2017, reject all statement of qualifications and direct staff to procure a new statement of qualifications with expanded scope of work and budget.

Executive Summary:

Rescind the award of contract from February 7, 2017, which consists of a study of the corridor of Lockett Road between Fourth Street and North Fanning Drive. Reject all statement of qualifications. Additionally, direct staff to procure a study with an expanded scope of work and budget which consists of Lockett Road/Cedar Avenue between North West Street and North Highway 89. The expanded scope of work has three (3) sections of differing study components. The western section (Section A) is defined as Cedar Avenue from the intersection of N. West Street heading east to N. Fourth Street. The middle section (Section B) is defined as E. Lockett Road between N. Fourth Street heading east to N. Fanning Drive. The eastern section (Section C) is defined as the realignment of N. Lockett Road connection to Highway 89.

Financial Impact:

The project is budgeted in Account #040-05-112-3337-6-4421 in the amount of $99,876 which will carry-forward into the FY2018 budget. Up to an additional $150,000 has been identified in other budget appropriations within the Transportation Tax Fund for an increase in scope if directed or needed.

Options and Alternatives:

1) Rescind the award, reject all statement of qualifications and direct staff to procure a new statement of qualifications with an expanded scope of work and budget as recommended to include Section A, B and C.
2) Rescind the award, reject all statement of qualifications and direct staff to procure a new statement of qualifications with a partially expanded scope of work and budget to include any combination of Sections A, B or C.
3) Proceed with award of contract from February 7, 2017

Background and History:

On February 7, 2017, a contract was awarded by Council to Kimley-Horn and Associates, Inc. in the amount of $99,972 to conduct a study of Lockett Road between Fourth Street and North Fanning Drive. During the City Council meeting on February 7, 2017, Council suggested to staff to explore expanding the scope of work to include additional roadway sections of the corridor. Staff exhausted all options allowed by the Procurement Code to expand the scope of work as the contract had not been executed. Staff concluded that the scope of work expansion not only exceeded the budgeted funds including those allowable by a change order, but also created professional design services beyond those solicited with the original statement of qualifications. Therefore, staff chartered a team to strategize options and presented to City Council at the budget retreat an option to expand the scope of work to include the suggested greater limits of the study inclusive of a funding source. At the City's budget retreat in April 2017, City Council directed staff to formally seek a rescind of the awarded contract from February 7, 2017, and to procure a new statement of qualifications with an enhanced scope of work and budget. The enhanced scope of work consists of a corridor study between North West Street and North Highway 89 along Lockett Road/Cedar Avenue.

Key Considerations:

Expanding the limits of the study from North West Street to North Highway 89 provides a holistic approach of community outreach regarding the corridor. The portion of the corridor on the eastern end near North Highway 89 creates the need for an alternate alignment which requires different design services than previously procured.

Community Involvement:

This study will help the community understand how the Lockett Corridor will accommodate future traffic needs.
