TITLE:

Consideration and Adoption of Resolution No. 2024-07:  A resolution approving an Intergovernmental Agreement between Coconino County and the City of Flagstaff for the Landfill Road Construction Project.

STAFF RECOMMENDED ACTION:

Executive Summary:

The City Council is being asked to consider and approve this IGA for the purpose of delivering and sharing the expenses of the landfill road rebuild project.  The primary entrance to the city's Cinder Lake Landfill is located north of the community intersecting Hwy 89N at the Johnson Ranch subdivision.  This 2-mile access road has been in poor condition for several years. The County and City began discussions dating back to 2019 to improve the road and provide users of the landfill a better road section.  After study, design, planning and coordination the two agencies have come to agreement in terms of funding and the delivery methods to complete the project.  Each agency will be contributing approximately 50% of the cost of construction and have agreed to the same proportional share for cost overruns or savings.  Once completed, the landfill customers will have a modern-day road with improvements that increase safety and provide smoother access.  The project is being delivered via a Construction Manager at Risk contract and will begin in Spring 2024 with expected completion in Fall 2024.

Financial Impact:

The City and County have agreed that each Party has a proportional responsibility for the Project, which is as follows:

Total Project Cost                               $ 5,060,520.00
County Proportional Share:                $ 2,440,000.00
City Proportional Share:                     $ 2,620,520.00

As provided above, the City shall be responsible for construction of the Project through the CMAR contractor and will be responsible for all payments to the contractor. The County will contribute funding to the Project as a direct payment to the City. If the cost of the Project exceeds the amounts identified in the initial costing proposals, the City and County will each be responsible for the difference consistent with the proportional shares identified above. Any cost savings will be refunded to the Parties according to the same proportional shares.

Policy Impact:

Providing well maintained infrastructure is a primary function of government. This IGA demonstrates the ability to work collaboratively with other agencies and deliver a project that will serve the region and city of Flagstaff.
