TITLE:

Consideration and Adoption of Resolution No. 2016-40:  A resolution of the City Council of the City of Flagstaff, Coconino County, Arizona, prescribing standards of financial disclosure for local elected officials. (Changing current legislation to be consistent with state law for local elected officials financial disclosure information)

RECOMMENDED ACTION:

Executive Summary:

In 1983, at the recommendation of the League of Arizona Cities and Towns, all cities/towns in Arizona adopted resolutions prescribing standards of financial disclosure for local elect officials, as authorized by A.R.S. 38-545. This resolution adopted standards that were consistent with the state requirements, but were specific for local cities/towns.

During this past legislative session, H.B. 2429 amended the financial disclosure statement that is required for candidates and public officers statewide. The primary changes were: 1) a new category on the statement that requires reporting of certain travel-related expenses, which when reported are exempt as a "gift" under the law; 2) no longer requires the specific names of the public officer's spouse or children to be included on the statement as long as a general description is provided and allows the public officer to provide a home or work address; and 3) the Secretary of State is authorized to prescribe the electronic format for the local public officer's financial disclosure statements. This law is effective on January 1, 2017.

The proposed resolution reflects these changes, in addition to the removal of the notarization requirement, but makes them specific to local officials. While not a statutory change, the Secretary's Office has interpreted the law requiring a "verification" on the statement to mean that notarization is not required.

Options and Alternatives:

1) Adopt the resolution as presented.
2) Amend the resolution (as long as the wording continues to be consistent with state law); or
3) Not adopt the proposed resolution, which could make the statewide form confusing for local officials to use because wording will not be consistent with state law.
