TITLE:

Consideration and Adoption of Resolution No. 2018-11:  A Resolution of the City Council of the City of Flagstaff, Arizona adopting amendments to the City's Procurement Code Manual to incorporate additional language applicable to six (6) Articles within the City's Procurement Code Manual.

STAFF RECOMMENDED ACTION:

1) Read Resolution No. 2018-11 by title only
2) City Clerk reads Resolution No. 2018-11 by title only (if approved above)
3) Adopt Resolution No. 2018-11

Executive Summary:

This Resolution is to amend the City's Procurement Code Manual that involves revisions to the following Articles:

Staff proposed amendments
1.  Informal and Formal Procurement Limits; Quote File Requirements (Article 7);
2.  Local Bid Preference Prohibited (Article 10);
3.  Code of Federal Regulations (CFR) (Article 14);
4.  Determination of Bidder and Proposer Responsibility (Article 16);
5.  Sole Source (Article 18); and
6.  Emergency Purchase (Article 19)

Note:  All of the proposed amendments to the Articles referenced above are specifically referenced in the attached Resolution to this staff summary.

On April 3, 2018, Council took up a discussion of and provided input on these staff recommended changes to the Procurement Code Manual.

Options and Alternatives:

1.  Adopt Resolution 2018-11 as submitted.
2.  Recommend revisions to Resolution 2018-11.
3.  Not adopt Resolution 2018-11.
 

Background and History:

The City has a formal, comprehensive, Procurement Code Manual which was approved and adopted by City Council under Resolution No. 2013-19 on July 16, 2013.  Any and all amendments are required to be adopted per City Code, Chapter 1, Section 20-001-0004.  On June 2, 2015, City Council approved and adopted Resolution No. 2015-24 regarding an amendment to the City's Procurement Code Manual to incorporate a new Article (Article 31), which allows the City to give a procurement preference to Arizona certified nonprofit agencies that serve or employ individuals with disabilities along with proposed language to be incorporated into the City's Procurement Code Manual.

This new Resolution No. 2018-11 is to obtain approval and adoption of the six (6) proposed amendments applicable to Articles within the City's Procurement Code Manual that are outlined in the attached Resolution.

Key Considerations:

Adopting the proposed language as amendments to the six (6) Articles within the City's Procurement Code Manual will:
1.  Provide better clarity and help eliminate varying interpretation to certain language applicable to the seven (7) Articles within the City's Procurement Code Manual;
2.  Strengthen compliance with local, state, and federal procurement rules and regulations; and
3.  Incorporate additional requirements to help strengthen and justify certain procurement decisions.
