TITLE:
Consideration and Approval of Contract: With Advanced Chemical Transport, Inc., d/b/a ACTenviro, for Hazardous Waste Removal and Disposition in an amount not to exceed $200,000.00.
STAFF RECOMMENDED ACTION:
- Approve the Contract with Advanced Chemical Transport Inc., d/b/a ACTenviro, on a time and materials basis for an amount not to exceed $200,000.00; and
- Authorize City Manager to execute the necessary documents.
Executive Summary:
The Hazardous Products Center (HPC) is a permanent facility dedicated to accepting and properly disposing of household hazardous waste (HHW) generated by residents and qualifying businesses of Flagstaff and Coconino County. To continue to provide this service, an "on call" service agreement must be in place for the timely removal and disposition of hazardous waste from the HPC.
Financial Impact:
Costs associated with this contract are budgeted for $200,000 in the miscellaneous services account for the HPC in the Solid Waste Fund and will be expended on a time and material basis per Exhibit A of the Contract.

- The HPC ensures the proper storage, treatment, disposal, or reuse of HHW within the City of Flagstaff and Coconino County. This prevents hazardous waste from entering the landfill and allows for reuse or recycling of HHW.
Has There Been Previous Council Decision on This:
Yes, previous hazardous waste removal and disposition contracts have been approved by City Council in 2010 and 2016. The current contract expires April 16, 2021.
Options and Alternatives:
Option A - Approve the Contract with Advanced Chemical Transportation, Inc., d/b/a ACTenviro, for hazardous waste removal and disposition. This will provide the City of Flagstaff HPC an on-call contract for the removal of hazardous waste from the facility.
Option B - Reject the Contract with Advanced Chemical Transportation, Inc., d/b/a ACTenviro, for hazardous waste removal and disposition. This option would leave the HPC with no contract for the removal of hazardous waste and would require City Staff to re-propose for the services.

Background and History:
The HPC provides a service to the residents and qualifying businesses of Flagstaff and Coconino County by providing them with a permanent facility to drop off and safely dispose of their hazardous waste.
The HPC also assists City of Flagstaff facilities with disposal of hazardous waste generated through their operations. These wastes are disposed of using safe, cost-effective, environmentally sound disposal methods that comply with all federal, state and local environmental regulations.
A formal solicitation was conducted through a Request for Proposals (RFP).
On January 28, 2021, the City posted a RFP to the City's PlanetBids electronic bidding platform, and advertised it in the Arizona Daily Sun on January 31 and February 7, 2021. On February 22, 2021, the City received five Proposals. A six-person evaluation committee was formed consisting of six City staff. Upon completion of the evaluation process, Advanced Chemical Transportation, Inc., d/b/a ACTenviro, was the highest scoring firm and deemed most qualified to perform the work.

By addressing the areas covered under this Contract, the HPC and City facilities will reduce the environmental impact of their operations, support the goals and operations of the Cinder Lake Landfill, and reduce the City of Flagstaff liability through safe, timely and cost-effective disposal of hazardous wastes.
