Consideration and Approval of Contract: Approval of a professional services contract with Gary R. Anglemyer & Associates, LLC in the amount of $68,500.00 for appraisal services for the Rio de Flag Flood Control Project (railroad properties).
STAFF RECOMMENDED ACTION:
- Approve the professional services contract with Gary R. Anglemyer & Associates, LLC in the amount of $68,500.00 for appraisal services for the Rio de Flag Flood Control Project (railroad properties); and
- Authorize the Mayor to execute the necessary documents.
Executive Summary:
The City of Flagstaff, as the Non-Federal Sponsor for the United States Army Corps of Engineers ("USACE") Rio de Flag Flood Control Project is responsible for delivering the real estate necessary to construct the project under the guidance and approval of the USACE. Real estate needed for the project impacts fifteen (15) parcels owned by the Burlington Northern Santa Fe Railway Company (BNSF). Valuation of railroad property interests requires specialized expertise, as value is tied to the transportation corridor owned by BNSF. This contract procures a transportation corridor appraiser approved by the USACE to prepare appraisals for the property interests needed for the project. These appraisals will establish the just compensation the City will offer to BNSF for the property interests needed for the project.
The City of Flagstaff was given the names of three companies which hold the credentials needed for the BNSF appraisal, per USACE. Of the three companies, Gary R. Anglemyer & Associates, LLC was determined to be the most responsive and responsible bidder and was chosen for the work.

Financial Impact:
The Contract will be funded by the Rio de Flag Flood Control Stormwater Capital Improvements FY 2022-2023 account budget of $4,085,744.00. Account (206-08-385-3236-0).

Has There Been Previous Council Decision on This:
There have been several council decisions related to real estate necessary for the Rio de Flag Flood Control Project:
- October 6, 1998, the City Council adopted Ordinance No. 1983 authorizing the acquisition of real property for flood control and to provide the opportunity for future development along the Rio de Flag and the Clay Avenue Wash.
- August 4, 2009, the City Council adopted an Ordinance No. 2009-22 amending Ordinance No. 1983 to add parcels of real property for flood control and redevelopment within the Rio de Flag Flood Control Project.
- February 18, 2020, the City Council adopted resolution 2020-05 authorizing the acquisition of real property interests necessary for the Rio de Flag Flood Control Project.
Key Considerations:
The Rio de Flag Flood Control Project is included in the City’s Stormwater Management Capital Improvement Program. The project has been the subject of numerous Council Meetings, City to Citizen communications and newspaper articles.
The USACE has received $52 million for its share (65%) of the project costs, per the Project Cooperation Agreement. The City has the capacity and commitment to fund our share of the project. In 2018, the City Council approved a rate increase to provide additional funding for the Stormwater Capital Improvement Program (CIP). In 2019, the rate increase went into effect. The value of the property interests acquired for the project will be credited towards our share of the project costs.
On April 12, 2021, the USACE submitted to the City of Flagstaff the real estate “take letter” outlining the property interests that need to be acquired for the project. It is the City’s responsibility to acquire the project corridor. After the project corridor is acquired, USACE will solicit, award and construct the project.
