TITLE:

Consideration and Adoption of Resolution No. 2023-55: A resolution of the Flagstaff City Council authorizing condemnation of real property for the Lone Tree Overpass project; providing for delegation of authority, and establishing an effective date

STAFF RECOMMENDED ACTION:

Executive Summary:

The Lone Tree Overpass project requires the City to acquire 27 square feet of land for right-of-way and a 1,134 square foot temporary construction easement from a property located at 602 East Butler Rd. Flagstaff, Arizona, 86001. The land is also known as parcel no. 104-04-008A by the Coconino County Assessor.

The property owner is willing to sell the property interests to the City. However, due to existing tax liens on the property, a condemnation proceeding is necessary in order for the City to obtain clear title to the required property interests. This resolution authorizes the City to file a condemnation proceeding for the property interests.

Financial Impact:

The just compensation to be paid for the property interests is $4,655.00, based on the City's appraisal. The City will incur additional expense as a result of filing a condemnation proceeding. The acquisitions will be funded by the Lone Tree Overpass Project Capital Improvements (Account No. 047-10-112-3054-6-4421)

On July 6, 2021, Council approved Ordinance 2021-15 authorizing acquisition of this properties, including others for the Lone Tree Overpass Project.
