Executive Summary:
The Arroyo Seco to Dortha Project, a project within the larger suite of Spruce Wash Channel Improvement Projects, will construct a channel above an existing storm drain between the houses on the West side of Rose St and the East side of Main St. Most of the construction activities will occur within existing platted easements for drainage; however, there are a few areas where the permanent drainage structure will require additional drainage easements. Additionally, there are some areas where temporary entry permits and temporary construction easements are necessary in order to grade the adjacent land into the slope of the channel. Importantly, the majority of the construction work will occur on the channel side of existing backyard fences. There may be some fences which need to be temporarily moved in order to construct, but temporary fencing will be installed and the existing fence will be salvaged or replaced in kind for those impacted property owners.
This ordinance authorizes staff to acquire those outstanding easements needed in order to construct the project. City staff will be offering to pay just compensation to the property owner for purchase of the real property, based on an appraised value or a market analysis. If the City is unable to reach an agreement with the property owner despite good faith negotiations, City Council will have the opportunity at a future public meeting to decide whether to adopt a resolution authorizing condemnation of the interests needed for the project.
