TITLE:

Consideration and Adoption of Resolution No. 2025-39:  A resolution adopting the City of Flagstaff Title VI Implementation Plan Relating to U.S Department of Transportation, Federal Highway Administration, and Federal Transit Administration Funding
 

STAFF RECOMMENDED ACTION:

  1. Read Resolution No. 2025-39 by title only
  2. City Clerk reads Resolution No. 2025-39 by title only (if approved above)
  3. Adopt Resolution No. 2025-39

Executive Summary:

A Title VI Implementation Plan is required to receive federal financial assistance to ensure programs and activities are free from discrimination based on race, color, or national origin.  The Title VI Plan demonstrates how the city will meet its legal obligations under Title VI of the Civil Rights Act of 1964.

There are no financial impacts to adopting the resolution.

Options and Alternatives to Recommended Action:

-  Approve the Title VI Implementation Plan
-  Do not approve the Title VI Implementation Plan, which may jeopardize receiving federal financial assistance.

Background and History:

Title VI of the Civil Rights Act of 1964 prohibits discrimination on the basis of race, color, or national origin in programs and activities receiving Federal financial assistance. Specifically, Title VI provides that "no person in the United States shall, on the ground of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance." (42 U.S.C. Section 2000d).

The Civil Rights Restoration Act of 1987 clarified the intent of Title VI to include all programs and activities of Federal-aid recipients, sub-recipients, and contractors whether those programs and activities are federally funded or not.
