Discussion of Relocation Ordinance

DESIRED OUTCOME:

Direct staff to add Relocation Policy to the legislative agenda to allow municipalities to create local relocation programs.

EXECUTIVE SUMMARY:

The draft relocation ordinance asked for an impact report for all mobile home owners, mobile home tenants and multi-family tenants.  City Council provided direction to decouple the multi-family requirement from the mobile home requirement.  Because the State of Arizona has a relocation program for mobile home owners the City is preempted from legislating in this area.  Staff recommends proceeding with a legislative agenda item requesting the State allow Cities to develop local relocation programs that can provide benefits to mobile home owners.
 
Without any legislative change, under our current Zoning Ordinance, an applicant seeking a rezoning will have to demonstrate consistency with the Regional Plan including Policy LU.1.12.  Therefore applications which result in the displacement of residents should anticipate addressing this development issue.  Staff is taking steps to identify applicable regional plan policies early in the review process so that applicants can prepare a successful project and be prepared to discuss displacement with impacted residents prior to public hearings.  Staff will continue to explore the feasibility to require owners notify tenants when a property is for sale, such as the posting of a "For Sale" sign.

REGIONAL PLAN:
Policy LU.1.11. Ensure that there is collaboration between a developer, residents, and property owners in existing neighborhoods where redevelopment and reinvestment is proposed so that they are included, engaged, and informed.

Policy LU.1.12. Seek fair and proper relocation of existing residents and businesses in areas affected by redevelopment and reinvestment, where necessary.
