TITLE:
Consideration and Adoption of Ordinance No. 2023-14: An ordinance of the City Council of the City of Flagstaff authorizing the acquisition of real property for the Lone Tree Overpass Project; providing for delegation of authority, subsequent City Council approvals, severability, and establishing an effective date.

Executive Summary:
In 2021, City Council passed Ordinance 2021-15, authorizing the acquisition of portions or all of properties needed for the Lone Tree Overpass Project. As design has progressed it has been determined that additional parcels will also be impacted. This ordinance is supplemental to Ordinance 2021-15, and authorizes the City to acquire the needed real property to complete the Lone Tree Overpass Project.
Financial Impact:
Costs of these acquisitions are not yet known. Funds for this will come from the funding provided for this project by Proposition 420 which established a tax and dedicated the use of the revenues for costs associated with this project.

Has There Been Previous Council Decision on This:
Yes, Ordinance 2021-15 was approved in June of 2021, and authorized the acquisition of real property for this project previously. Further evolution of the design has identified additional acquisitions that are required to complete the project and this new ordinance is supplemental to the original.
Background and History:
In November of Flagstaff voters passed Proposition 420, to establish a local transaction privilege tax rate for 20 years to pay for the Lone Tree Overpass Project. That project continues to progress and the design now shows impacts on parcels that were not included in the original acquisition ordinance in 2021. This ordinance will authorize the City to work to acquire the necessary rights to complete the project.
