TITLE:

Consideration and Adoption of Resolution No. 2023-60: A resolution of the Flagstaff City Council, authorizing condemnation of real property for the Highway 180 Culvert Project; providing for delegation of authority, and establishing an effective date.

STAFF RECOMMENDED ACTION:

Executive Summary:

The Highway 180 Culvert project requires a drainage easement of 50,787 square feet and a temporary construction easement 7,065 square feet from property owned by the Museum of Northern Arizona located on the east side of Fort Valley road, south of Creekside drive. The land is also known as parcel no. 111-01-025D by the Coconino County Assessor. The property is burdened by existing open space restrictive declarations preventing use of the property for the intended drainage purposes of the project. A condemnation proceeding is sought in order for the City to obtain clear title to the required property interests unencumbered by the restrictive covenants. This resolution authorizes the City to file a condemnation proceeding for the property interests.

Financial Impact:

City funding for the permitting, design, acquisition, and construction is secured through a FY24 State appropriation.
