TITLE:
Consideration and Ratification of Settlement: settlement of Ashley Overall Notice of Claim dated July 31, 2024.
STAFF RECOMMENDED ACTION:
- Approve settlement of the Ashley Overall claim pursuant to the terms discussed in executive session, and
- Authorize and direct the City Manager and/or City Attorney to execute all documents and take other actions as are necessary to finalize the settlement.
Executive Summary:
This Notice of Claim stems from property damage due to a blockage in the City's sewer main, near 8565 N. Steves Boulevard. Ms. Overall is seeking payment for damages as a result of the blockage. City staff worked with Ms. Overall to reach a settlement of this particular claim and are now seeking ratification by the City Council. The settlement and legal advice related hereto were discussed with the City Council in Executive Session on October 22, 2024, and November 19, 2024.
Financial Impact:
Funding for this settlement is available through the City's self-insurance trust fund.
