TITLE:
Consideration and Approval of Contract: Change Order No. 1 with Eagle Mountain Construction, Inc. in the amount of $1,990,330, to the Cedar Crossing, GMP 4, Amendment No. Four, as part of the Spruce Wash Flood Mitigation Suite of Projects.
STAFF RECOMMENDED ACTION:
- Approve Change Order No. 1 for Cedar Crossing in an amount of $1,990,330; and
- Authorize the City Manager to execute the necessary documents.
Executive Summary:
Staff recommends approval of Change Order No. 1 to the Cedar Crossing, GMP 4, Amendment No. Four to the CMAR Construction Services Agreement No. 2023-60 (Agreement), with Eagle Mountain Construction, Inc. (EMC), for the Spruce Wash Flood Mitigation Suite of Projects (the Suite).
Change Order No. 1 would increase the amount for GMP No. 4 (Cedar Crossing) by $1,990,330 for a total GMP#4 amount of $3,940,273.54.
Change Order No. 1 is for asphalt pavement mill and overlay for Cedar Avenue under the Road Repair and Street Safety program, including concrete roadway edge improvements as needed. The limits are Cedar Avenue from West Street to the west edge of the new Cedar-Fourth-Lockett Roundabout and on West Street from the Linda Vista slip ramp to Cedar Avenue (next to the Wedge detention basin).
The existing pavement is in fair to poor condition and has been impacted by trenching for new utilities to accommodate the Spruce Wash drainage improvements. Cedar Avenue was programmed for road repair in the near future, however, it is advantageous to perform the work now as part of the Spruce Wash program. Funding will come from the Spruce Wash and Road Repair Street Safety programs.

Change Order No. 1 will be funded from the Spruce Wash, Cedar Avenue Crossing, Fund 410, Account No. 410-08-385-3524-3-4442. The Road Repair and Street Safety, FY2025-26 fund will provide supplemental funds as needed and will replenish the 410 fund.
The approved Spruce Wash – Cedar Avenue Crossing FY2025-26 budget is $1,587,652 and the Road Repair and Street Safety fund, Road Repair Pavement Preservation program FY2025-26 budget in 046-06-163-3321-6-4443 is $13,553,983.

The City Council previously approved Amendment Four with EMC for GMP#4, Cedar Crossing, on October 1, 2024.
Options and Alternatives to Recommended Action:
- Approve Change Order No. 1 as recommended. Approval will allow work to comply with the grant provisions; or,
- Reject approval of the award as recommended.
- If rejection occurs, possible options include:
- Ask staff to re-evaluate the recommendation; or
- Suspend the project and seek an alternate funding source which is uncertain and would delay or jeopardize completion.

Background and History:
On July 21, 2019, the Museum Fire broke out in the Dry Lake Hills area just above Flagstaff within the Coconino National Forest. The fire charred 1,961 acres, including a significant portion of the Spruce Wash Watershed. Throughout the summer of 2021, monsoon rain events on the Museum burn scar caused multiple flood events in Flagstaff neighborhoods.
In November 2022, voters approved Proposition 441 with support from 76% of Flagstaff voters. The Proposition invests $57 million in City of Flagstaff wildfire suppression, stormwater flood mitigation and wastewater treatment infrastructure. Specifically, $26 million of this funding will be used to fund stormwater infrastructure improvements in the Spruce Wash area to lessen the impacts of flooding in affected neighborhoods.
Engineering design commenced in 2022 for a suite of drainage improvements in the Museum flood areas of the Paradise, Grandview and Sunnyside neighborhoods. In April 2023, the City awarded Eagle Mountain Construction the CMAR design and construction phase services contract for the suite of projects. There have been multiple GMPs since construction commenced.
Construction of the Cedar Crossing box culvert commenced in January 2025. The work included utility relocations to accommodate an enlarged box culvert. Work is substantially complete.
