TITLE:
Consideration and Adoption of Resolution No. 2025-21: A resolution adopting the amended Flagstaff Water Services Enforcement Response Plan (ERP) to include updates to language and various job titles.

Executive Summary:
The 2018 Enforcement Response Plan (ERP) which was later revised in 2022 was developed to provide clear direction to City staff on how to respond to noncompliance, and to the regulated community about the escalating enforcement procedure. This plan is a requirement for the Industrial Pretreatment and Municipal Separate Storm Sewer System (MS4) programs. In its current state, the plan needs a refresh for certain items. There are no changes that will affect the enforcement processes or any monetary penalties. The summary of changes is as follows:
- Update narrative to have the Stormwater Section match Pretreatment and Cross-Connection in language.
- Update Watershed Specialist to Stormwater Project Manager
- Add in Floodplain language from City Code.
- Update Stormwater and Regulatory Compliance Managers to Water Services Manager/Section Director.
- List existing Scavenger Waste violations to give staff direction on enforcement.
Financial Impact:
No changes.
Policy Impact:
These amendments to the Enforcement Response Plan will give City staff more guidance and clarity. The changes having the most significant impact are the title changes to give other necessary City staff the ability to be included in the escalated enforcement.

Background and History:
The ERP was adopted in December of 2018 and was revised in 2022.

Environmental Stewardship - Encourage the private sector's investment in environmental stewardship. The ERP allows the regulated community the opportunity to rectify any wastewater or water issues with minimal enforcement by the City.
