TITLE:

Consideration and Approval of Contract: First Amendment to Consultant Services Contract with ATL, Inc. d/b/a CMT Technical Services.
 

STAFF RECOMMENDED ACTION:

  1. Approve the First Amendment to the Consultant Services Contract with ATL, Inc. d/b/a CMT Technical Services in an amount of $150,000; and
  2. Authorize the City Manager to execute the necessary documents.

Executive Summary:

ATL, Inc. d/b/a CMT Technical Services ("CMT Technical Services") has been providing materials testing consultant services for the City of Flagstaff under a Consultant Services Agreement since February 20, 2025. Material testing services include quality assurance for all permitted City infrastructure improvements, is managed by the City Engineer, and reports directly to assigned City staff. This First Amendment will add an additional year to the term of the Consultant Services Agreement and an additional cost of $150,000. By adding $150,000 to the cost of the Consultant Services Agreement, the threshold value of this contract will exceed $100,000, thereby requiring City Council approval under the City Charter.

Previous Council Decision or Community Discussion:

Council approved a contract with CMT Engineering Laboratories on May 21, 2019. That contract expired in 2025 and was replaced with a one-year contract, which is now being extended for an additional year to allow for a formal solicitation to be completed.  

Options and Alternatives to Recommended Action:

  1. Approve the First Amendment to the Consultant Services Agreement, as recommended; or
  2. Reject the First Amendment and provide additional direction to staff. This option would impact the ability of the City to perform quality assurance testing for infrastructure improvements.

Background and History:

The elimination of the City's in-house materials testing personnel and laboratory in 2014 intimated the need to hire a private sector firm. The current contract with the private sector firm will end soon and needs to be extended and more funding to be agreed to. The Purchasing team is currently working on a formal solicitation to establish a long-term contract with the awarded firm.
