TITLE:
Consideration and Approval of Settlement: in the matter of Dustin Royal v. City of Flagstaff, et al., 3:25-CV-08094-ASB, currently pending in the United States District Court for the District of Arizona.
STAFF RECOMMENDED ACTION:
- Approve settlement of the matter of Dustin Royal v. City of Flagstaff, et al., pursuant to the terms of the tentative settlement discussed in executive session on July 31, 2026, and August 25, 2026, and
- Authorize and direct the City Attorney to execute all documents and take such other actions as are necessary to finalize the settlement.
Executive Summary:
This litigation stems from an automobile accident involving Mr. Royal that occurred on June 28, 2024, near the intersection of North Fourth St. and E. Route 66 in Flagstaff. Mr. Royal is alleging injuries and seeking damages as a result of the accident.
The City has reached a tentative settlement of this particular litigation, subject to the approval of the City Council. The tentative settlement and legal advice related thereto were discussed with the City Council in executive session on July 31, 2026, and August 25, 2026.
