TITLE:

Consideration and Approval of Contract:  Approve the construction contract with Capital Improvements, LLC. in the amount of $2,590,575.00 for the Zuni Drive Improvements Project

RECOMMENDED ACTION:

1) Approve the construction contract with Capital Improvements, LLC in the amount of $2,590,575.00 and a contract time of 235 calendar days;
2) Approve Change Order Authority to the City Manager in the amount of $239,000.00 (10% of the contract amount, less allowance);
3) Authorize the City Manager to execute the necessary documents.

Executive Summary:

Award of this contract will authorize the construction of the Zuni Drive Improvements project in accordance with the approved public improvement plans prepared by Kimley-Horn & Associates, Inc. dated September 27, 2016.  The work will construct new water main, new water and sewer services, a new storm water system and a new road pavement. 
 
The project is scheduled in the Capital 5-year plan and is funded primarily by the Proposition 406, Road Repair and Street Safety Tax in the amount of $4,000,000.  An additional $85,200 in funding is provided by Utilities Aging Water Infrastructure Replacement (AWIR). 

Financial Impact:

The 5-year capital program has a total project budget of $4,000,000.   The total budget in account 046-05-116-3328-6 for FY2017 is $2,340,000 with an additional $1,450,000 in FY2018 for this project.  Utilities has also programmed $85,200 for the segment of water main in Cochise Drive.

Policy Impact:

No impact. 

Connection to Council Goal and/or Regional Plan:

3) Provide sustainable and equitable public facilities, services, and infrastructure systems in an efficient and effective manner to serve all population areas and demographics

Has There Been Previous Council Decision on This:

Council previously approved the ballot language for the Proposition 406 for the Road Repair and Street Safety Tax.  The Council adopted the FY17 budget at the June 21, 2016 Council meeting and this appropriation was included in that budget.

Options and Alternatives:

1)  Approve the award as recommended.  Approval will allow work to move forward in calendar 2017 or;
2)  Reject all bids.  This action would delay the project.  If rejection occurs, possible options include:
         a)  Re-advertise the project and open new bids;
         b)  Suspend or cancel the project. 

Background and History:

The project has a general scope to upgrade the water main, water and sewer services, create a storm water system and build new road pavement.  With Council approval of the contract, work is targeted to begin as soon as weather allows in 2017.  The project is programmed in the Capital Improvement 5-year plan. 
 
Staff posted the Invitation for Bids (IFB) solicitation for construction on October 27, 2016 on the City website and Purchasing's electronic bidding website, and advertised in the newspaper on October 30 and November 13, 2016.  There were 7 bids received on the opening date of November 29, 2016 and staff determined that Capital Improvements, LLC is the lowest responsive and responsible bidder.

Below is a summary of the bids received.  The bid tabulation sheet is included as an attachment.  Bid extensions were corrected (indicated on the bid tabulation sheet) but does not impact the bid order.

Change Order Authority establishes a dollar amount (10% of the contract amount, less allowance) and provides the City Manager, on behalf of the Council, authority to amend the contract amount in response to unforeseen costs that are more than the contracted amount. 
 

Community Involvement:

Inform - In September 2016 approximately 1,200 postcards were mailed to the property owners and residents of the Bow & Arrow neighborhoods giving notice of the upcoming public information meeting to review and discuss the proposed Zuni Drive Improvements project.  The Project Manager's  contact information (e-mail and telephone) was provided for people who could not attend the meeting.

Involve - A public information meeting was held on October 18, 2016 at Fire Station #6 on Lake Mary Rd. 

Empower - Voters authorized the Road Repair and Street Safety Tax (Proposition 406) in November of 2014.

Expanded Options and Alternatives:

City staff held a public information meeting on October 18, 2016 at Fire Station #6.  The project scope was presented and discussions were held with community members in attendance.
