TITLE:

Consideration and Adoption of Resolution No. 2019-07:  A resolution to authorize entering an Intergovernmental Agreement (IGA) with State of Arizona Department of Veterans Services (ADVS) to provide Building Inspection Services for the construction of a new Veterans Home located at 2100 N. Gemini Drive on McMillan Mesa.

Executive Summary:

State law allows the City of Flagstaff to enter this IGA by resolution of the City Council.  The agreement will be between the State of Arizona through the Arizona Department of Veterans Services and the City of Flagstaff.  The proposed IGA governs the responsibilities, terms, and conditions related to the City providing building inspection services in connection with the construction of the Veterans Home located at 2100 N. Gemini Drive. The Building Safety program has the capacity to provide this contract service.

Staff is recommending the adoption of this resolution to ensure building inspection services are provided to this state facility.

Financial Impact:

No financial impacts are anticipated in entering this IGA.

Normally, payment for inspection services would be captured as part of the building permit fees.  However, because this is a State-owned facility, a normal building permit won't be issued by the City of Flagstaff.  Through this IGA, the ADVS is agreeing to reimburse the City for the costs of providing building inspection services.  The estimated value of building inspection services is $32,109.  Billing to ADVS will occur monthly based on hours of inspection services provided.

There are no policy impacts associated with this Inter-Governmental Agreement.

Council Goals
Social Justice-- Resolution of IGA will support state initiative to provide services to a population segment with special needs; this facility will provide healthcare services for an underserved population.
Affordable housing-- Resolution of IGA will support goal of increasing affordable housing to a population that sometimes has trouble finding affordable housing, this facility will house approximately 100 people.
Transportation-- Resolution of IGA will support goal of regional transportation plan to provide opportunities for multi-modal transportation, this facility will have a bus stop.
Regional Plan-- Resolution of IGA will be in alignment with previous Council's decision to identify the Veterans Home as a 'special district' within the overall development of the McMillan Mesa business park.

Background and History:

The property at 2100 N. Gemini Drive was formerly owned by the City of Flagstaff and used as a materials storage yard.
The property was deeded to the State on 12/6/2016 by ordinance no. 2016-41 for construction of a Veterans Home.

Key Considerations:

AZDS requested that the City of Flagstaff Building Safety section provide inspection services to allow more timely inspections, which could not be provided by State inspectors to meet construction timelines.
