Consideration and Adoption of Resolution No. 2019-06: A resolution authorizing the execution of a Development Agreement between Flag Holdings LLC and the City of Flagstaff related to the development of approximately 2.92 acres of vacant land (APN 107-16-008S) generally located at 1411 North Fourth Street.

Executive Summary:
State law allows the City to enter into development agreements by resolution. The proposed Development Agreement with Flag Holdings, LLC ("Owner") vests the Owner’s development rights under the approved Site Plan for one year after the completion of the Fourth Street Corridor Complete Street Project improvements, to allow Owner to coordinate its development with the project, thereby minimizing traffic congestion and inconvenience to the traveling public along Fourth Street. In addition, the Development Agreement is a condition of resolving a related condemnation action.
Financial Impact:
The Site Plan identifies public improvements adjacent to the Flag Holding's property that the City will be constructing as part of the Fourth Street Complete Street Project per standard practice, plus the City will pay the incremental cost of traffic signalization (estimated at $15,000) needed for Flag Holding's Tiny House Village as part of the CIty's overall project.

On December 17, 2017, Council adopted Ordinance No. 2017-29, authorizing the City to acquire a strip of Flag Holdings' property for a public use (the Fourth Street Corridor Complete Street Project/public right-of-way improvements). The CIty offered to purchase the strip. The offer was not accepted, therefore in February 2018 City filed a condemnation action to acquire the strip.

Background and History:
In February 2018 the CIty filed a condemnation action to acquire a strip of property from Flag Holdings, LLC that the City needed for the Fourth Street Complete Street Project.
In the meantime, Flag Holdings moved forward with plans for its development of the remainder parcel located along the west side of Fourth Street. In January 2019 City Community Development staff approved the Site Plan for a Tiny House Village project.
The project envisions an upscale, mountain style, enclave that will be a great place to live an affordable and sustainable lifestyle. A "manufactured home park" as defined by the Zoning Code, the project's intent is to rent spaces and the units on them, with the option for the residents to buy the units themselves. The ownership group will retain the ownership of the land in perpetuity. The project will fill a gap of sorely needed affordable housing. By virtue of being small and efficient, the units will be lower cost to rent than a traditional home.
The project consists of 24 manufactured homes, 6 travel trailers, and a community center with a community room/kitchen, laundry facilities, and restrooms. The proposed structures meet the Architectural Design Guidelines of the Zoning Code. Access to the site will be at the intersection of Fourth Street and Soliere Avenue. Although not in the Resource Protection Overlay, the developer intends to save almost half of the existing trees to add to the aesthetic of the park and offset landscaping requirements. A 6-foot high masonry wall will provide the residents with privacy from the busy adjacent roadways. The proposed development meets our outdoor lighting standards, parking requirements, and landscaping standards.

The street needs to connect to the bridges. There will be less traffic congestion if the Owner delays its development until after the ADOT and City projects are done.
