TITLE:
Consideration and Approval of a Contract: Material Testing Professional Services
STAFF RECOMMENDED ACTION:
- Approve the Professional Services Contract with ATL, Inc. dba CMT Engineering Laboratories for an estimated annual amount of $220,500.00; and
- Authorize the City Manager to execute the necessary documents
Executive Summary:
The Professional Services Contract will authorize annual material testing services, which provides quality assurance for all permitted City infrastructure improvements. The contracted private sector firm, CMT Engineering Laboratories, is managed by the Office of the City Engineer and reports directly to assigned City staff. The Professional Services Contract will be for a term of three (3) years with two (2) additional one-year renewal options. Payment will be The annual contract renewals are contingent upon a successful performance review at the discretion of the City.
Financial Impact:
The contract is funded by Engineering Permit Fee revenues with an FY19 budget authorization of $243,798 (account 001-05-102-0314-4-4206). The agreement is an estimated annual amount of $220,500.

The Engineering Permit Fee was originally established by Ordinance 2013-17 in July 2013. The current Materials Testing fee is 3% of the public improvement construction cost.
Options and Alternatives:
1. Approve the Professional Services Contract as recommended. Approval of the contract will allow CMT Engineering Laboratories to set up operational activities for material testing work; or
2. Reject the Professional Services Contract and provide additional direction to staff. This option would impact the ability of the City to perform quality assurance testing for infrastructure improvements in 2019.

Background and History:
The elimination of the City's in-house materials testing personnel and laboratory in 2014 initiated the need to hire a private sector firm. The current contract agreement with the private sector firm will end in mid-2019.
Key Considerations:
Three firms submitted Statements of Qualification for performing materials testing. A five-person evaluation committee independently reviewed each submittal and scored the firms on the following criteria; the firm and their assigned personnel’s qualifications, expertise, knowledge, experience and service strategies as related to materials testing.

Community Involvement:
Infrastructure improvements that become property of the City are built to standards established by the Office of the City Engineer. The quality assurance verifies that these improvements comply with the City’s established standards and is achieved using materials testing protocols, trained personnel and approved laboratory testing methodologies.
