TITLE:
Consideration and Adoption of Resolution No. 2019-28 and Ordinance No. 2019-19: A resolution and ordinance amending the Flagstaff City Code, Title 8, Streets and Public Ways and Title 9, Traffic, Chapter 9-05, Bicycles.

Executive Summary:
The proposed ordinance will amend Title 8, Streets and Public Ways to:

- Prohibit persons and entities from placing property in the public right-of-way without a City permit.
- The property may be impounded with a $100.00 fine
- Add a requirement for individuals to provide truthful name and date-of-birth when detained upon reasonable suspicion that a violation of the Chapter has been committed, and make it unlawful to operate an electric bicycle or electric scooter under the influence of drugs or alcohol. Staff would like to clarify information that was presented to council on May 28, 2019, with regard to the Pedestrian Advisory Committee and the Bicycle Advisory Committee and their recommendations regarding these provisions. The results of the straw polls on these provisions were as follows:
- Pedestrian Advisory Committee (May 9)
- Truthful Name and Date of Birth: YES Vote = 4-0,
- Operating under the influence: NO Vote = 0-4,
- If Council to consider adopting then Operating under the Influence with Reduced penalties: YES Vote = 4-0
- Bicycle Advisory Committee (May 2)
- Truthful Name and Date of Birth: YES Vote = 4-3
- Operating under the influence: NO Vote = 3-4
- If Council to consider adopting then Operating Under the Influence with Reduced penalties: YES Vote = 7-0
- Pedestrian Advisory Committee (May 9)
- Council may also want to address the proposed penalties section as this issue was not fully discussed at the meeting on May 28, 2019.
- Require a permit agreement to allow vendors to locate bicycles or scooters in the right-of-way for the purposes of renting the devices.
- Indicate where electric bicycles and electric scooters are allowed or prohibited on sidewalks, downtown sidewalks, FUTS trails, and bike lanes.

The financial impact should be limited to staff time and resources necessary to roll-out and provide education for the new provisions.
