TITLE:

Consideration and Approval of Off-Track Wagering Facility Permit: J&J Equine Enterprises, LLC, dba Arizona Downs, located at Dirty Birdies Sports Bar & Grill, 2285 E. Butler Avenue.

STAFF RECOMMENDED ACTION:

Approve the New Off-Track Wagering Permit for J&J Equine Enterprises, LLC, dba Arizona Downs.

Executive Summary:

An application has been received from J&J Equine Enterprises, LLC, dba Arizona Downs to permit off-track wagering at Dirty Birdies Sports Bar & Grill. Off-track wagering is the telecast of live audio and visual signals of live or simulcast horse, mule, or greyhound racing programs conducted at an authorized location by a racetrack permitted for the purpose of wagering. Arizona Downs is responsible for the operations of the wagering windows at the proposed location and only allows for horse race wagering.

Section 6-01-001-0012, Gambling, of the Flagstaff City Code, allows for off-track wagering when authorized by the Flagstaff City Council. The City Council may consider any information contained within the application. Dirty Birdies Sports Bar & Grill is an existing business in Flagstaff and Arizona Downs, who has had off-track wagering for many years, is moving their window to this location from The Museum Club. This is a a location transfer application. If approved, it will be the only off-track wagering facility in Flagstaff.

The process for off-track wagering applications starts at the local governing board and a letter of final vote is sent to the applicant and the location. The applicant then sends the letter of final vote to the Arizona Gaming Commission with their final application. 

The Police Department and Community Development have reviewed the application with no concerns noted.

Off-Track Wagering Permits are a regulatory action and there is no Council goal that applies.

Previous Council Decision on This:

An approval for an Off-Track Wagering Facility Permit for J&J Equine Enterprises, LLC, dba Arizona Downs, located at The Museum Club was approved by Council on August 21, 2018.
