TITLE:

Consideration and Approval of Ratifying the Contract:  Ratify the Emergency Construction Contract between the City of Flagstaff and Fann Contracting, Inc. in the amount of $2,274,445 for the Schultz Creek Sediment and Flood Detention Basins Project.

STAFF RECOMMENDED ACTION:

  1. Ratify the Emergency Construction Contract with Fann Contracting, Inc. in the amount of $2,024,445, and an Owner's Contingency of $250,000, for a total amount of $2,274.445 which amount includes all federal, state, and local taxes, as applicable.
  2. Approve the Administrative Change Order Authority to the City Manager in the amount of $177,444.50 (10% of the Contract Amount, less the Contract Allowance); and
  3. Authorize the City Manager to execute the necessary documents.

Executive Summary:

Approval will ratify the City Manager's acceptance of the Emergency Construction Contract with Fann Contracting, Inc. ("Fann") which will provide protection from flooding, restore the hydraulic capacity to the natural environment to the maximum extent practical, and reduce threats to life and property.

Financial Impact:

Fann was selected to perform the work for completing the Schultz Creek Sediment and Flood Detention Basins ("Project"). Five construction companies were contacted and were invited to bid on the Project. These contractors were invited to bid due to the size and construction constraints needed (complete start to finish was 10 days) for the Project. All five contractors received a pre-final plan. The City subsequently received an extension for completing the Project and contacted all five contractors to allow them to consider the time extension in submitting their bids. Of the five contractors, three contractors submitted bids. Fann was the lowest bidder and is within the Project budget. The bid information is below.

This Project is funded in part by the U.S. Department of Agriculture, Natural Resource Conservation Service, Emergency Watershed Protection Program which provided federal funds in the amount $2,408,180.75 for the Project. Staff has identified budget appropriation in account number 206-08-331-1258-0-4364 in FY 2022-23 for this project. Funds will be expended against the grant project account number 206-08-385-3517-0-4442, project number WS3517B.

Policy Impact:

This ratifies the City Manager's acceptance of the Emergency Construction Contract award to Fann which will allow the construction of the Schulz Creek Sediment and Flood Detention Basins. This Project will provide protection from flooding, restore the hydraulic capacity to the natural environment to the maximum extent practical, and reduce threats to life and property.

Options and Alternatives:

  1. Ratify and accept the Emergency Construction Contract with Fann which will fund the Project construction.
  2. Not ratify or accept the Emergency Construction Contract with Fann and the Project will not be constructed and the grant award funding will de-obligated back to the funding agency.

Background and History:

On Sunday, June 12, 2022 the Pipeline fire (within the Coconino National Forest) began and burned approximately 26,500 acres. The burn area as a result of this fire stretches multiple watersheds that were irritably impacted. One of the major watersheds affected contributes to Schultz Creek (westerly side of the pipeline burn area). JE Fuller, one of the City's engineering consultants, generated a potential flood map (2-inch in 45-minute storm) of the Schultz Creek, post fire, utilizing approved engineering standards (FLO-2D mapping). The map that was generated illustrate a large impact to multiple subdivisions within the City of Flagstaff with potential flooding depths from less than an inch to 5 feet or more.

Key Considerations:

The Project consists of constructing three large detention basins located on a City owned parcel to aid in stormwater management (Schultz Creek) peak flow attenuation and provide a means for sediment deposition within these basins. The inclusion of these basins on this property is expected greatly reduce the intensity of the peak flow from rainfall and discharge from the burn scar area.

Community Involvement:

The Project that Fann will be constructing will help reduce / relieve imminent threats to life and property caused by post wildfire flooding.
