TITLE:
Consideration and Approval of Contract: Contract for Rio de Flag channel maintenance in the Cheshire neighborhood to J. Banicki Construction for the amount of $463,886.50.
STAFF RECOMMENDED ACTION:
- Award the contract to J. Banicki Construction for Rio de Flag channel maintenance in the Cheshire neighborhood for the amount of $463,886.50; and
- Authorize the City Manager to execute the necessary documents.
Executive Summary:
The Rio de Flag resides within a constructed/engineered channel through the Cheshire neighborhood. The original design for the channel was a 25-foot width with 2:1 side slopes and an adjacent maintenance road. This channel experienced flooding in 2021 resulting in property damage. The purpose of this maintenance contract is to dredge the channel from near Boldt Drive to Cheshire Park to regain most of the original design capacity.

- Approve the Construction Contract with J. Banicki Construction for the maintenance item; or
- Deny the contract and allow the channel to continue to function in its current state.
Background and History:
Stormwater staff first solicited bids from the City's Horizontal Construction Job Order Contractor (JOCs) firms in early spring 2025. All four Horizontal Construction JOCs indicated that they would not have the capacity in the near-term to complete the project. Stormwater staff were then instructed to contact the Water Services JOCs, which was done in late spring 2025. All three Water Services JOCs declined to bid. This Construction Contract with J. Banicki Construction is through a cooperative contract, and at an appropriate cost following a procurement process, after exhausting the JOC route. The public relations for this work will be coordinated with Beta PR through a separate contract and land surveying and staking was conducted by Ardurra Engineering in spring 2025.
