TITLE:
Consideration and Approval of Contract: First Amendment to the Construction Manager at Risk (CMAR) Construction Phase Services Agreement with Eagle Mountain Construction, Inc. in an amount of $4,555,128.00 to add Phase 1 - GMP 2 for the Wildcat Interceptor Sewer Upsizing Project.
STAFF RECOMMENDED ACTION:
- Approve the First Amendment to the CMAR Construction Phase Services Agreement with Eagle Mountain Construction, Inc. (EMC) in an amount of $4,555,128 to add Phase 1 - GMP 2 for the Wildcat Interceptor Sewer Upsizing Project (Project); and
- Approve an Owner's Contingency of $100,000, which is approximately 3% of Phase 1 - GMP 2; and
- Authorize the City Manager to execute the necessary documents.
Executive Summary:
Staff recommends approval of the First Amendment to the CMAR Construction Phase Services Agreement to add Phase 1 - GMP 2 with EMC for the Project. The purpose of the Project will be to construct approximately 5,900 feet of new sewer main from the Wildcat Hill Wastewater Treatment Plant (WWTP) to the south side of Interstate 40 which will increase capacity in the sewer collection system and replace a critical piece of aging infrastructure. Phase 1 - GMP 2 will allow the contractor to install the new sewer main from the Wildcat Hill WWTP up until the first crossing of the Rio de Flag, approximately 3200 linear feet.
Financial Impact:
- CMAR Construction Phase Services Agreement Phase 1 - GMP 2 will cost $4,555,128 and will cover the first phase of construction from the Wildcat Hill WWTP up to the first Rio de Flag crossing. Staff anticipates a potential need for additional GMPs in the future to cover the balance of the scope and any additional items identified in the 100% plans and intends to bring any additional contracts to the City Council for consideration.
- This Project is funded through Water Services in both Wastewater and Reclaimed Water in the following accounts:
- Account # 203-08-375-3441-0 with a budget of $6,000,000 in FY2025-26 and $2,000,000 in FY2026-27.
- Account #203-08-375-3558-0 with a budget of $2,000,300 in FY2025-26
- Account #204-08-380-3558-0 with a budget of $970,136 in FY2025-26.
Policy Impact:
Policy F3.4 Compliance: The City of Flagstaff will submit a report to ADEQ for any new subdivision, site, system extension or collection system expansion as currently required by law.

- The current wastewater collection system is undersized for new development. The new sewer interceptor will replace the existing undersized sewer main to provide additional capacity to the wastewater collection system.
- The project will also replace a critical piece of aging infrastructure.
Previous Council Decision or Community Discussion:
- On June 16, 2024, the City Council approved a Professional Services Contract with Ardurra Group, Inc. to design the Wildcat Sewer Interceptor Upsizing Project. Ardurra has completed the engineering design documents up to the 90% level.
- On May 27, 2025, the City entered into a Design Phase Services Agreement with EMC in the amount of $78,750.00 for basic design phase services (see attached).
- On July 1, 2025, the City entered into a Construction Phase Services Agreement, including, Phase 1 - GMP 1 with EMC in the amount of $5,374,180 to order long lead time materials and set up a materials storage yard.
Options and Alternatives to Recommended Action:
- Approve the First Amendment to the CMAR Construction Phase Agreement to add Phase 1 - GMP 2 in the amount of $4,555,128, as recommended; or
- Reject approval of the award as recommended. This action would delay the Project and certain developments currently in review that are contingent on the completion of the Project.
- If rejection occurs, possible options include:
- Ask staff to re-evaluate the recommendation; or
- Suspend or cancel the Project completely.

Background and History:
In 1971, the City of Flagstaff constructed the Wildcat Hill Wastewater Treatment Plant and a new large diameter sewer interceptor to transport wastewater from the then current treatment plant to the new treatment plant. In a recent Water and Sewer Impact Analysis, the City of Flagstaff’s consultant identified a deficiency in the wastewater collection system in this sewer interceptor. This Project was also identified in the City of Flagstaff’s 2015 Sewer Master Plan as the second highest priority project. The pipeline is currently undersized to meet the additional developments that have been proposed. This Project will replace a portion of the undersized pipeline identified in the water and sewer impact analysis with a new larger wastewater interceptor. The new pipeline will allow the City to properly serve the wastewater needs of the new proposed developments.
Following the completion of 30% design plans by Ardurra, the Purchasing section posted a Request for Statements of Qualifications (RSOQ) solicitation for Construction Manger at Risk on December 6, 2024, on the PlanetBids website, and advertised it in the Arizona Daily Sun newspaper on December 17 & December 28, 2024. There were four Statements of Qualifications received by the due date of January 14, 2025.
After reviewing the Statements of Qualifications received by the evaluation team of six professionals, the RSOQ selection panel selected the highest scoring firm, Eagle Mountain Construction, Inc. to move forward to award. On May 27, 2025, the City entered into a Design Phase Services Agreement with Eagle Mountain Construction, Inc. for the amount of $78,750.00 for basic design phase services. The firms' final evaluation ranking scores are as follows:
