NOTICE OF OPTION TO RECESS INTO EXECUTIVE SESSION
 
Pursuant to A.R.S. §38-431.02, notice is hereby given to the members of the City Council and to the general public that, at this regular meeting, the City Council may vote to go into executive session, which will not be open to the public, for discussion and consultation with the City's attorneys for legal advice on any item listed on the following agenda, pursuant to A.R.S. §38-431.03(A)(3).

MISSION STATEMENT
 
The mission of the City of Flagstaff is to protect and enhance the quality of life for all.
 
LAND ACKNOWLEDGEMENT
 
The Flagstaff City Council humbly acknowledges the ancestral homelands of this area's Indigenous nations and original stewards. These lands, still inhabited by Native descendants, border mountains sacred to Indigenous peoples. We honor them, their legacies, their traditions, and their continued contributions. We celebrate their past, present, and future generations who will forever know this place as home.

OPEN CALL TO THE PUBLIC

Open Call to the Public enables the public to address the Council about an item that is not on the prepared agenda. Comments relating to items that are on the agenda will be taken at the time that the item is discussed. Open Call to the Public appears on the agenda twice, at the beginning and at the end. The total time allotted for the first Open Call to the Public is 30 minutes; any additional comments will be held until the second Open Call to the Public.

If you wish to address the Council in person at today's meeting, please complete a comment card and submit it to the recording clerk as soon as possible. Your name will be called when it is your turn to speak. You may address the Council up to three times throughout the meeting, including comments made during Open Call to the Public and Public Comment. Please limit your remarks to three minutes per item to allow everyone an opportunity to speak. At the discretion of the Chair, ten or more persons present at the meeting and wishing to speak may appoint a representative who may have no more than fifteen minutes to speak.

Pursuant to A.R.S. §38-431.02, notice is hereby given to the members of the City Council and to the general public that the City Council may vote to go into executive session, which will not be open to the public, for the purpose of discussing or considering employment, assignment, appointment, promotion, demotion, dismissal, salaries, disciplining or resignation of a public officer, appointee, or employee of any public body...., pursuant to A.R.S. §38-431.03(A)(1).

Consideration of Appointments: Housing Commission
 
 
STAFF RECOMMENDED ACTION:
 
  1. Mayor Daggett to make one appointment to a Low Income Housing Expert position.
  2. Councilmember House to make one appointment to a Low Income Housing Expert position.
  3. Councilmember Garcia to make one appointment to a Builders and Real Estate Professional - Realtor position. 
 
8.
CONSENT AGENDA

All matters under Consent Agenda are considered by the City Council to be routine. Unless a member of City Council expresses a desire at the meeting to remove an item from the Consent Agenda for discussion, the Consent Agenda will be enacted by one motion approving the recommendations listed on the agenda. Unless otherwise indicated, expenditures approved by Council are budgeted items.

Ratification of FY26 Insurance Renewal Premiums
 
 
STAFF RECOMMENDED ACTION:
 

Ratify the insurance renewal premiums for FY26 submitted by: 1) Arizona Municipal Risk Retentional Pool (AMRRP) for General Liability, Errors and Omission (E&O), Sexual Abuse and Molestation (SAM), Property, Auto, Marine, Crime, Cyber, Excess, and Workers' Compensation coverage; 2) Aon Risk Insurance Services West (Aon) for Airport Liability; 3) Aon for International Travel; and 4) Industrial Commission of Arizona (ICA) to fund the Firefighters Presumptive Cancer Claims.
 
B.
Consideration and Approval of Contract: First Amendment to the Construction Manager at Risk (CMAR) Construction Phase Services Agreement with Eagle Mountain Construction, Inc. in an amount of $4,555,128.00 to add Phase 1 - GMP 2 for the Wildcat Interceptor Sewer Upsizing Project.
 
 
STAFF RECOMMENDED ACTION:
 
  1. Approve the First Amendment to the CMAR Construction Phase Services Agreement with Eagle Mountain Construction, Inc. (EMC) in an amount of $4,555,128 to add Phase 1 - GMP 2 for the Wildcat Interceptor Sewer Upsizing Project (Project); and
  2. Approve an Owner's Contingency of $100,000, which is approximately 3% of Phase 1 - GMP 2; and
  3. Authorize the City Manager to execute the necessary documents.

Consideration and Adoption of Ordinance No. 2025-18: An Ordinance of the City Council of the City of Flagstaff, amending the Flagstaff City Code Title 7, Health and Sanitation, Chapter 7-03 City Water System Regulations of the City of Flagstaff City Code by amending Section 87-03-001-0011 Water Main Capacity Charges.

B.
Consideration and Adoption of Ordinance No. 2025-15: An ordinance of the City Council of the City of Flagstaff, authorizing the acquisition of real property interests for the Wildcat Interceptor Sewer Upsizing Project; providing for delegation of authority, providing for severability, authority for clerical corrections, and establishing an effective date

D.
Consideration and Approval of Contract: Change Order No. 1 with Eagle Mountain Construction, Inc. in the amount of $1,990,330, to the Cedar Crossing, GMP 4, Amendment No. Four, as part of the Spruce Wash Flood Mitigation Suite of Projects.
 
 
STAFF RECOMMENDED ACTION:
 
  1. Approve Change Order No. 1 for Cedar Crossing in an amount of $1,990,330; and
  2. Authorize the City Manager to execute the necessary documents.
 
E.
Consideration and Approval: A request for Preliminary Block Plat approval for Canyon del Rio Phase 2 located at 3200 E Butler Avenue within the Single-family Residential (R1) zone and the Medium Density Residential (MR) zone.
 
 
STAFF RECOMMENDED ACTION:
 

Approve the Preliminary Plat, in accordance with the findings presented in this report and the Planning and Zoning Commission recommendation of approval (7-0 on August 13, 2015) with the following conditions:
  1. The final plats for each phase shall be in substantial conformance with the preliminary plat including the phasing plan and map (sheets PH01 and PH02) of the preliminary Block Plat of Canyon del Rio Phase 2.  Each phase and parcel of the Canyon del Rio plat must meet all requirements independently.
  2. The Final Plat for Canyon del Rio Phase 2 must meet the conditions of approval in the IDS approval comment letter dated June 5, 2025, as well as the conditions in the Traffic Impact Analysis Approval Memo dated July 10, 2025 (staff and the applicant are continuing to discuss the proportional share contribution for improvements at the Whetstone and Fourth Street Intersection, as well as responsibility for payment of that proportional share; the conditions related to improvements at the Whetstone and Fourth Street Intersection may be revised or removed depending on the outcome of those discussions).

Consideration and Adoption of Ordinance No. 2025-17: An ordinance of the City Council of the City of Flagstaff, amending the Flagstaff Zoning Map to rezone approximately 13.82 acres of real property located at 2951 S Masonic Lane, from the Rural Residential (RR) zone within the Resource Protection Overlay Zone (RPO) and Suburban Commercial (SC) zone within the RPO to the Medium Density Residential (MR) zone within the RPO, providing for severability, authority for clerical corrections, and establishing an effective date.

Consideration and Adoption of Resolution No. 2025-44: A resolution adopting the Adaptive Reuse Bond Program, which provides framework for the expenditure of approximately $3,000,000 in general obligation bond funds for the creation of affordable rental units.

Consideration and Adoption of Resolution No. 2025-42 and Ordinance No. 2025-16:  A Resolution of the City Council of the City of Flagstaff, Coconino County, Arizona, declaring as a public record that certain document filed with the City Clerk entitled "PZ-25-00041 - Single Use Residential in the Commercial and Public Facility Zones and Adaptive Reuse Incentives" and an Ordinance of the City Council of the City of Flagstaff, Coconino County, Arizona, amending the Flagstaff City Code, Title 10, Flagstaff Zoning Code.

Consideration and Approval of Contract: First Amendment to the Cooperative Purchase Contract with Flock Safety in the amount of $112,000, in addition to other fees and taxes, for safety cameras for the Flagstaff Police Department

Consideration and Direction on Citizen Petition: Freeing Flagstaff from invasive surveillance
 
 
STAFF RECOMMENDED ACTION:
 
  1. Police Department presents on the contract amendment.
  2. Introduce the citizen petition and take public comment.
  3. Council provides direction on the citizen petition.
    1. If petition is advanced, postpone action on the contract amendment until after the citizen petition discussion
    2. If petition is declined, take action on the contract amendment
  4. Approve the First Amendment to the Cooperative Purchase Contract with Flock Safety in the amount of $112,000, in addition to other fees and taxes, to the purchase of the Flock Cloud-Based Public Safety Program to include thirty-two (32) Flock Safety cameras and (1) Flock Safety Falcon system for the north and south downtown districts; and authorize the City Manager to execute the necessary documents.
