NOTICE OF OPTION TO RECESS INTO EXECUTIVE SESSION
Pursuant to A.R.S. §38-431.02, notice is hereby given to the members of the Heritage Preservation Commission and to the general public that, at this regular meeting, the Heritage Preservation Commission may vote to go into executive session, which will not be open to the public, for legal advice and discussion with the City’s attorneys for legal advice on any item listed on the following agenda, pursuant to A.R.S. §38-431.03(A)(3).

Mr. Whiteman discussed an unpermitted and unauthorized work on a house within the Townsite Overlay and that the property owner and her fiduciary were unaware of the work and had not authorized it. The privacy of neighbors has been impacted. Fence line and property line are not the same and so the setback cannot be from the fence.

Approve a grant for a maximum of $10,000 on a 50/50 basis per the Historic Facades and Signs Grant Program. Grant money is to be utilized for window replacement of 9 window opens, a front door and associated railing work only on the historic Malapai Stone portion of the building (1935). The historic portion of 606 N. Beaver was the offices Dr. Daniel Wright Kittredge, Jr. a notable surgeon and general practitioner from 1942-1964.

The property owner did extensive research but he could not find any historic photos of the property. The new windows are being matched to the historic ones that are now sealed shut. There are windows on additions that are not historic. The grant is only being applied to the windows on the historic portion of the building (the malpais structure).

Approve a Certificate of Appropriateness for window replacement project within the Townsite Overlay Zone. 15 windows with new hollow component vinyl windows replacing failed metal units. Circumstances of contractor not aware of permitting & review. Mitigation with appropriate trim-out with 1 x 6 face trim detailing and that property not visible from street or impacting neighboring properties.
Staff recommends approval of the Certificate of Appropriateness if the Commission determines that the submission by the applicant shows that the window replacement project has no significant adverse effect on the integrity of the residential structure and neighboring properties.

The project received a stop work order because there was confusion. It is a contributing structure in the Townsite Overlay. Mark Reavis recommends allowing the new windows with appropriate trim details, as the mitigation, due to the low visibility of the structure within the district.

Commissioner Webber asked if there is an update on how outreach on windows replacement and other permitting is going forward. Mark Reavis believes there are fewer issues like this occurring in the Downtown and Townsite Overlay. Outreach will continue. Mark confirmed that it is moving in the right direction.
