Call to Order
NOTICE OF OPTION TO RECESS INTO EXECUTIVE SESSION


Pursuant to A.R.S. §38-431.02, notice is hereby given to the members of the Commission and to the general public that, at this regular meeting, the Commission may vote to go into executive session, which will not be open to the public, for legal advice and discussion with the City’s attorneys for legal advice on any item listed on the following agenda, pursuant to A.R.S. §38-431.03(A)(3).
Chairman Jones called the meeting to order at 4:01 p.m.

Due to Open Meeting Laws, the Commission cannot discuss or act on items presented during this portion of the agenda. To address the Commission on an item that is on the agenda, please wait for the Chair to call for Public Comment at the time the item is heard.

APPROVAL OF MINUTES
Approval of the minutes from the meetings on Wednesday, May 25 and June 8, 2022.
Mary Norton motioned to approve the minutes of the meeting of June 8th, 2022, Lloyd Paul seconded the motion. Motion passed unanimously 
 

Moved by Carole Mandino, seconded by Mary Norton approve the minutes of the regular meeting of May 25, 2022 as submitted

PUBLIC HEARING
 
A.
PZ-22-00074: Noble Herb’s request for a Zoning Code Text Amendment to modify the existing Marijuana Dispensary hours.
Staff recommends the Planning and Zoning Commission, in accordance with this report, find that the required findings of the Zoning Code have been met, and that the Planning and Zoning Commission make a recommendation to the City Council for approval of the Zoning Code Text Amendment.
 
Tiffany Antol, Zoning Code Manager, gave a PowerPoint presentation on the proposed Zoning Code Text Amendment and answered questions from Commissioners.
Pele Fischer, applicant representative, answered questions from Commissioners
Douglas Daly, Counsel for Noble Herb, answered questions from Commissioners

Motion was made and withdrawn by Carole Mandino in accordance to the report and findings of the zoning code recommend to City Council approval of PZ-22-00074 Zoning Code Text Amendment to modify the dispensary hours from 7 p.m. to 10 p.m.
 

Moved by Carole Mandino, seconded by Mary Norton  to forward to City Council a zoning code text amendment to modify the existing dispensary hours from 8 p.m. to 9 p.m. in accordance with the report and the findings of the zoning code

Moved by Marie Jones, seconded by P. Lloyd Paul PZ-22-00074 Zoning Code Text amendment to modify the existing dispensary hours from 8 p.m. to 10 p.m. to be forwarded to City Council for approval in accordance with the findings
Commissioner Norton decent was due to finding #1 pharmacy store vs pharmacy counter and finding #2 safety of City would like to see alignment with County and other cities nearby

PZ-22-00089: City’s request for a Zoning Code Text Amendment to modify the existing Marijuana Dispensary land use and Specific to Use provisions for Marijuana Establishments to address Proposition 207 – Smart and Safe Arizona Act (recreational use of marijuana) that was approved by the Arizona voters in November 2020 and the recent issuance of social equity licenses.
Staff recommends the Planning and Zoning Commission, in accordance with this report, find that the required findings of the Zoning Code have been met, and that the Planning and Zoning Commission make a recommendation to the City Council for approval of the Zoning Code Text Amendment.
 

Moved by Mary Norton, seconded by Marie Jones to send to City Council for approval in accordance with the findings PZ-22-00089 Zoning Code Text Amendment as presented by Staff to include the distance to 2500 feet.

GENERAL BUSINESS
 
A.
Preliminary Plat PZ-19-00019-07 for Rio Homes Unit 4 Multifamily 
A request by RP4V, LLC and RP40, LLC for Preliminary Plat approval for Rio Homes Unit 4 Multifamily, a 6-unit multi-family residential townhome subdivision. The 5.1-acre site is located at 1221 East Emma Drive in the MR, Medium Density Residential Zone, and has a Resource Protection Overlay (RPO) zone.
In accordance with the findings, staff recommends the Planning and Zoning Commission forward the Preliminary Plat to the City Council with a recommendation for approval.
Genevieve Pearthree, Senior Planner, gave a PowerPoint presentation on both proposed Preliminary Plats PZ-19-00019-07 & PZ-19-00019-06 and answered questions from Commissioners

Blake Schraufnagel, applicant, answered questions from Commissioners

Ursula Montano, resident, request Commission to recommend a minimum 30 day rental period, fencing/screening be considered
 

Moved by Carole Mandino, seconded by Mary Norton Preliminary Plat PZ-19-00019-07 approval for Rio Homes Unit 4 Multifamily, a 6-unit multi-family residential townhome subdivision in accordance with the findings and staff recommendations forward to City Council for approval

Preliminary Plat: PZ-19-00019-06 Rio Homes Unit 4 Multifamily Condominiums
RP40, LLC and RP4V, LLC request approval of the Preliminary Condominium Plat for Rio Homes Unit 4 Multifamily, a 40-unit multi-family residential condominium subdivision. The 4.11-acre site is located at 1221 E. Emma Drive in the Medium Density Residential (MR) Zone and has a Resource Protection Overlay (RPO) zone.
Staff recommends the Planning and Zoning Commission, in accordance with the findings presented in this report, forward the Preliminary Plat to the City Council with a recommendation for approval.
