Call to Order
NOTICE OF OPTION TO RECESS INTO EXECUTIVE SESSION
Pursuant to A.R.S. §38-431.02, notice is hereby given to the members of the Heritage Preservation Commission and to the general public that, at this regular meeting, the Heritage Preservation Commission may vote to go into executive session, which will not be open to the public, for legal advice and discussion with the City’s attorneys for legal advice on any item listed on the following agenda, pursuant to A.R.S. §38-431.03(A)(3).
Chair Emily Dale called the meeting to order at 4:03pm.

LAND ACKNOWLEDGEMENT

The Heritage Preservation Commission humbly acknowledges the ancestral homelands of this area’s Indigenous nations and original stewards. These lands, still inhabited by Native descendants, border mountains sacred to Indigenous peoples. We honor them, their legacies, their traditions, and their continued contributions. We celebrate their past, present, and future generations who will forever know this place as home.
Commission Abbey Buckham read the land acknowledgment.

At this time, any member of the public may address the Commission on any subject within their jurisdiction that is not scheduled before the Commission on that day. Due to Open Meeting Laws, the Commission cannot discuss or act on items presented during this portion of the agenda. APPROVAL OF MINUTES

Approve the minutes of the January 17, 2024 Heritage Preservation Commission.

REQUESTED ACTION:
Review and possible approval of minutes.
Commissioner Duffie Westheimer requested staff to review section 6A for grammatical and spelling errors.
 

Moved by Duffie Westheimer, seconded by Abbey Buckham to approve the minutes of the January 17, 2024, Heritage Preservation Commission with the grammatical and spelling amendments under section 6A.

Vote: 5 - 0 - Unanimously

GENERAL BUSINESS
 
A.
Caitlin Kelly Plaque presentation.
Presentation of Heritage Preservation Commission Service Plaque to Caitlin Kelly, acknowledging service from January 2019 to November 2023.
Mark Reavis, Heritage Preservation Officer (HPO), presented Caitlin Kelly, former Heritage Preservation Commissioner with a plaque honoring and recognizing her years of service on the Heritage Preservation Commission.
Caitlin Kelly served on the Heritage Preservation Commission from January 2019 through November 2023.
Caitlin Kelly thanked Mark Reavis and stated she thoroughly enjoyed her time spent on the commission. She also thanked the current commissioners and extended her gratitude to the Commissioners for volunteering and their hard work.

PUBLIC HEARING

Phase 1 Historic Resource Study for Peris House in Flagstaff.

Accept the resubmitted Historic (Cultural) Resource Study for the Peris house, as submitted by Cornerstone Environmental Consulting,LLC.
Accept the revised Cultural Resource Study with included edits of more imagery of Mill Town housing, maps, and working with descendants on further and accurate information. Mitigation in the form of one complete interpretive plaque installation at the Peris Home site and the inclusion of the cost of production of a second mitigation plaque with a donation to the Riordan Action Network, affiliated with Riordan Mansion State Park.The Peris House plaque text, layout and content produced by Cornerstone shall be shared with Riordan State Park so that an identical physical plaque can be produced and the text and photos for the Riordan Plaque be similar and interrelated. A small area shall be reserved for  inclusion of a QR code to be added later for supplemental information supporting the concept of future additional installations along the Riordan Road corridor.


 
Mark Reavis, HPO, introduced the public hearing topic, reminding everyone that the topic is back on the agenda from last month’s meeting for the second review for the Peris House and the cultural resource study.
HPO Reavis included, the previously submitted Cultural Resource noted the need for two plaques but did not include a specific commitment to indirect impacts to Riordan State Park and providing commensurate mitigation with only the Peris Home site as the specific commitment. HPO Reavis noted, Heritage preservation 1030.30, zoning requires addressing both direct and indirect impact to cultural resources. HPO Reavis stated, on 02/12/2024 a meeting with the Cultural Resource Consultant and Chick-fil-A legal representatives clarifying requirements for addressing indirect impacts to Riordan state park, with the contribution of $3,000.00 for the physical production of a plaque, brackets, and posts. This excludes the development of research and text writing of the state park plaque to be provided by others but was shared information to coordinate plaques as a series to be potentially expanded upon. Additional information and edits were provided by the consultant in the new submitted document.
 
Josh Edwards from Cornerstone Environmental updated the Commissioners that he addressed the comments from the Commission and included adding two maps, which were Sanborn maps, showing the relationship of the property to Mill Town (Milton). Josh Edwards also mentioned he interviewed Tom Eickmeyer, but there was not a huge amount of information about Salvador and Florence’s life. However, he was able to provide good information regarding the layout of the house’s interior, which is ripped out now.
Furthermore, Josh Edwards also spoke about the meeting with HPO Reavis and Chick-fil-A representatives and agreed to the revisions to the Cultural Resource Study and installation of a plaque at the location of the house; prepared by Josh Edwards and will consult with Riordan Mansion personnel. In addition, Chick-fil-A agreed to donate another $3,000.00 to the Riordan Action Network that can be used towards installing a plaque at the Riordan Mansion State Park.
HPO Reavis shared with the Commissioners he is comfortable that they’ve complied with both direct and indirect effects on the demolition of the Peris House, and the indirect impacts to Riordan State Park.
Nikki Lober, Riordan Mansion State Historic Park Manager, spoke to the Commissioners to make note at the 02/12/24 meeting, it was suggested Chick-fil-A be acknowledged on each plaque and Nikki Lober inquired with senior leadership at Arizona State Parks and Trails, asking if the acknowledgment will be permitted with state policies, but have not received an answer yet.
 
Commissioner Westheimer noted from the previous meeting the HPC wanted and agreed a map showing the relationship of the Peris House with Riordan Mansion be added to the Cultural Resources Study and was not added, but can be added to figure four, figure 37, or figure 39.
In addition, Commissioner Westheimer mentioned wherever the plaque is put in the parking lot to be thoughtful about protecting if from snowplow drivers and who is responsible for ongoing maintenance of the plaque.
 
Commissioner Buckham agreed with Commissioner Westheimer that she would like the family relationship highlighted a little bit more.
 
Commissioner Hayes also agreed with Commissioner Westheimer. She would like to see more of a map that shows the relationship to Riordan Mansion.
 
Commissioner Dea concurred with all that was stated.
 
Chair Dale asked HPO Reavis, who will be financially responsible for the writing of the interpretation on the plaque, the second plaque?
HPO Reavis added plaque number one at the Peris House site is planned landscaping along with parking lot improvements and is allocated in a safe place while still oriented toward the sidewalk and facing Riordan Road, and Josh Edwards will be utilizing his research in writing the text for the plaque and adding two or three pictures in addition, saving a place for a QR Code.
The additional $3,000.00 that will be donated is for the second plaque allocated for the physical production, the mounting bracket, and pole at Riordan Mansion. Riordan Mansion personnel wants to do the interpretation themselves.
 
Lindsay Schube with Gammage and Burnham Attorneys at Law, addressed the Commission; on behalf of Chick-fil-A, would amend the map, work with staff to reference the exhibits Commissioner Westheimer addressed, and agree to maintain plaque number one on their property. Lindsay Schube added that historic preservation cases do run with the land not the landowner, similar to a zoning case.  Lindsay Schube also added they would love to have the Chick-fil-A logo referenced on the plaque, but if not approved, okay with removing the logo.
 
 

Moved by Abbey Buckham, seconded by Alycia Hayes to accept the revised Cultural Resource Study with included edits and mitigation in the form of one complete interpretive plaque installation at the Peris Home site with space reserved for a future QR code and the inclusion of the cost of the physical production of a second mitigation plaque with a donation to the Riordan Action Network. HPO to confirm donation and complaiance with mitigation products as well as a map referencing the relation to the Riordan House.

Vote: 5 - 0 - Unanimously

A.
CONSULTATIONS

Section 106 (ongoing) federal projects.
Mark Reavis, HPO noted part of his responsibilities working within a certified local government is to comment on all section 106 undertakings that take place. He also added that he tracks those and any impacts that may impact historical resources.
HPO Reavis shared a few updates with ongoing projects which include, the Lone Tree Overpass, the Downtown Mile, and the realignment of the Rio De Flag.
HPO Reavis reiterated that as he continues to track and work on these projects he will continue to update the Commission and keep all Commissioners informed.
