CALL TO ORDER

Chair Mandino called the meeting to order at 4:00 p.m.

Due to Open Meeting Laws, the Commission cannot discuss or act on items presented during this portion of the agenda. To address the Commission on an item that is on the agenda, please wait for the Chair to call for Public Comment at the time the item is heard.

APPROVAL OF MINUTES

Approval of the minutes from the regular meeting on Wednesday, September 11, 2024

Moved by Mary Norton, seconded by Ian Sharp to approve the minutes from the September 11, 2024 meeting.
Vote: 5 - 0 - Unanimously
 
5.
PUBLIC HEARING
 
A.
PZ-24-00010: City’s request for a Zoning Code Text Amendment to modify Division 10-20.50: Amendments to the Zoning Code Text and Zoning Map to add required review timeframes for Zoning Map Amendments as well as updating protest procedures for Zoning Map Amendments.

Staff recommends the Planning and Zoning Commission, in accordance with this report, find that the required findings of the Zoning Code have been met, and that the Planning and Zoning Commission make a recommendation to the City Council for approval of the Zoning Code Text Amendment.

Tiffany Antol, Zoning Code Manager, gave a PowerPoint presentation and answered questions from the commission. 

Moved by Mary Norton, seconded by CJ Lucke to recommend City Council for approval of Zoning Code Text Amendment PZ-24-00010 - Zoning Map Amendment Process, in accordance with the findings presented in this report.
Vote: 5 - 0 - Unanimously
 
B.
PZ-24-00008:  City’s request for a Zoning Code Text Amendment to amend Section 10-20.30.050: Concept Plan Review to remove the requirements for Duplex Dwelling to go through Concept Plan Review; modify Section 10-40.60.020: Accessory Structures to clarify requirements for accessory structures; modify Section 10-40.60.020: Accessory Uses to clarify requirements for accessory uses; modify Section 10-40.60.180: Home Occupations to align size allowances with building codes; modify Section 10-50.20.030: Architectural Standards to incorporate standards for Basements, Basement Garages, Building Stem Walls, Crawl Spaces, and Podium Parking Structures; delete Division 10-50.25: Basements, Basement Garages, Building Stem Walls, Crawl Spaces, and Podium Parking Structure Walls.

Staff recommends the Planning and Zoning Commission, in accordance with this report, find that the required findings of the Zoning Code have been met, and that the Planning and Zoning Commission make a recommendation to the City Council for approval of the Zoning Code Text Amendment.

Moved by CJ Lucke, seconded by Mary Norton to recommend in accordance with the findings presented in this report that the Planning and Zoning Commission Recommends to the City Council approval of Zoning Code Text Amendment PZ-24-00008 – Concept Plan Review, Accessory Structures, Accessory Uses, Home Occupations, and Basements, Basements, Basement Garages, Building Stem Walls, Crawl Spaces, and Podium Parking.

Vote: 6 - 0 - Unanimously
 
C.
PZ-24-00134: City’s request for a Zoning Code Text Amendment to modify Section 10-40.60.030: Accessory Dwelling Units (ADUs) to comply with state legislation including modifications to the permitted number, size, location, parking requirements, and design standards for Accessory Dwelling Units.

Staff recommends the Planning and Zoning Commission, in accordance with this report, find that the required findings of the Zoning Code have been met, and that the Planning and Zoning Commission make a recommendation to the City Council for approval of the Zoning Code Text Amendment.

Tiffany Antol, Zoning Code Manager, gave a PowerPoint presentation and answered questions from the commission. 

Moved by Ian Sharp, seconded by Megan Weller - Regarding PZ-24-00134 that the Planning and Zoning Commission, in accordance with the findings in this report, find that the required findings of the Zoning Code have been met, and that we recommend to the City Council to approve the Zoning Code Text Amendment.
Motion Failed
Vote: 3-3 Tie 

Moved by Mary Norton, seconded by CJ Lucke New Recommendation made by Mary Norton, recommends that City Council denies the Zoning Code text amendment PZ-24-00134.
Motion passed
Vote: 5-1

Public Comment was made after the vote by Tyler Denham in support of the proposed Zoning Code text amendment.
 
 
6.
GENERAL BUSINESS
 
A.
Discussion: Accessory Dwelling Unit (ADU) Model Plans Pilot Program

Genevieve Peartree, AICP | Resilence Analyst, presented and answered questions from the commission.

Ian Sharp and Megan Weller volunteered and will serve on the ADU Model Plans Pilot Program Committee.
