SUBJECT:
Request for release of Bond Numbers CMS0333671 and 09164702 from Crown Castle currently held by the City as a requirement for the performance of utility work within the rights-of-way of the City of Fort Pierce.
SUMMARY:
The Florida Legislature recently passed SB1000, which amended Section 337.401(d)(12) Florida Statutes, prohibiting a municipality from requiring a performance bond for the deployment of small wireless facilities in the public rights-of-way.
RECOMMENDATION:
Staff has reviewed the request for the release of bonds from Crown Castle and recommends the release of these bonds.
ALTERNATIVES:
Staff will proceed as directed by the City Commission.
