VIOLATIONS:

FINDINGS/ORDER:

On September 25, 2008 the Special Magistrate gave the owners 30 days to comply or a fine of $200.00 a day would be assessed.

ACTION DATES:

1.  November 13, 2008 an inspection was made, the property was not in compliance, the fines began.
2.  February 24, 2009 the Order Assessing Fines and Imposing Lien was recorded.
3.  December 5, 2014 following another inspection it was determined that due to the property's soil always being wet it is impossible to comply the violations, the case was closed and the fines were stopped.
4.  January 20, 2015 received Reduction of Penalty Request from Raphael Ammar.

RECOMMENDATION:

Amount of lien is $442,620.00.
Staff recommends waiving entire balance due to the fact that it was not possible to cure the violation. The manager of the property has maintained, and continues to maintain, the exterior of the property that is not impacted by the wetlands.
